1. Don't phone them.
2. If they phone you and you pick it up (you don't have to), make it clear that you are recording the conversation. If you CAN record it, so much the better.
3. As you've had this in writing, reply with a prove-it. At the end of the letter, replace 'OFT with 'OFT, FOS and CSA' - we can go into details later if we need to. For clarity, you can also add 'I now require all further correspondence from your company to be made in writing only' - there is a telephone harassment letter if we get further problems.
4. Can you write to Empire (and keep a copy) asking them to confirm your conversation in writing? There's not much point them putting a note on their old file as it appears they have sold the debt to Capquest and it's Capquest's tracing activites (and their attitude) that are causing the problems here.
5. Please be assured that there is nothing these idiots can do to you.0 -

After doing some more investigation along with the former catalogue who are being very helpful.
The lovely lady I spoke to in Fraud Section helped me with this information. 1, the account these debt people are talking about is over 13 years old and closed. 2, there is no debt company on there records anymore seeking the money as the account is so old and no longer acctive. 3, they themselves are looking into where and why these people are bothering me due to an account there not seeking money for.
So my questions today are theres, how can they claim after I have been told by the catalogue themselevs there is no company seeking money for them for this 13 year old account.
And as I posted a prove it letter to them this morning...shall I sit and wait to see what happens.
All of it has me stumped as I do not understand how, why and where these people are demanding I pay them, if the catalogue has closed this and can clearly see no debt company seeking money they do not want.....then where does this all go now??

Just to edit this....the company have said they have proof of my purchases and signature. So I have asked for proof of this as well....I hope that was right in asking for.

(1) There is no debt, so Carpquest/Helix can take take a very long walk off a very short pier.
(2) Even if there was a mistake and there was a debt, at over 13 years old it would be statute barred. And Carpquest/Helix would be completely burgered anyway.
So whichever way you cut it, Carpquest/Helix are on a hiding to nothing, and are acting unfairly.
Complain as fatbelly explained.

:mad: Okay I am still not having much luck with CapQuest/Hellix.
I posted that letter as I said and yet the post didn't arrive.
Phoned up the post office and they do not understand why it hasn't been signed for....there investigating for me.
But now the cheeky so and so's send me a letter about doorstep recovery.
I have finished my ivestigation with the catalgue involved and as I said the account is 13 years old and closed, with no debt company working for them....so I cannot understand why this company is trying to get money.
I will be sending another letter, but I am really fed up with these people....they seem persistant about a debt that no longer is being collected for.....13 years old and with no company seeking the payment....things don't make sense in why Hellix/Capquest are trying to claim the money.
Do I continue with the letters and do I refuse to allow anyone access to my home....as I really do not want them at my home for someone elses debt.
Please help this is getting weird for us, thanks to anyone to help me out.0 -
Very very very very very unlikely that anyone will turn up. Even if they do, they have no rights and you can tell them to naff off, and call the police if they won't.
No point sending letters for ever with these fools. They know the account is a duff one, so they are just digging themselves a deeper hole.

Hello, I've had a quick look through some of the posts on this forum and think I'm in the right place for some advice...
I've been dealing with CapQuest since December 2011, when they sent me two letters saying they had purchased debts of mine from Natwest with a Natwest headed paper saying they had done so. I ignored it for a while until the phonecalls started- at least 5 per week.
I did have two debts with Natwest- not for the amount they are now saying I owe. One was for an overdraft, the other a personal loan.
After around 10 conversations with various staff of theirs saying I need to send £1 for this info, and £10 for that info- none of it I'm really sure about, I sent them two cheques for £1 asking for a signed copy of my agreements. £1 in a cheque form has been returned to me, although I'm not sure why so have never put it in the bank.
One of their staff told me that as one debt was a current account they didn't need a signature to reclaim the debt but I would have had to sign a contract for the account so have asked for proof anyway.
I have sent them a letter (of which they have acknowledged) asking not to be contacted by phone as I am currently pregnant and find it very stressful, and that unless they can provide me with a copy of my signature I won't be making any payments to them.
They sent one back saying they are in the process of getting the signature for one (fair do's) and are asking me for proof of residence at the time the account was opened (12/12/2006 apparently) and proof of ID. I didn't reply and so the phonecalls have started again. I spoke to one of thier employees, telling him I didn't want to be contacted by phone, that I was between houses when they are asking for proof so don't have any, and that I have been advised it's against my best interests to give him any ID...he got rather shirty after that and said he didn't know what would happen next. I'll tell you- I got another letter requesting the same as before- proof of residence and proof of ID.
So, any advice would be greatfully received as to what I can do next!

I just wanted to post up my experience with capquest! I recieved a letter in June saying I owe money for a Next Directory account that I know I have never opened! After talking to capquest, they gave me the information of when the account was opened in a flat that I used to live in and the person used my name and a different address. They informed me that I need to send a letter to prove when I moved out, which I did. Now they are saying that this is not good enough! After getting very stressed I finally phoned next (which I should have done before) I just wanted to check that this account was actually opened, they guy understood this as fraud and said I have to sent them a copy of the letter stating when I moved out of the property. They said they will take over all corraspondance with capquest. Fingers crossed this will all be dealt with now. I also got a crime reference as I reported it to a fraud company.
Hope other people have a bit of luck with this stupid company.0
