Thats exactly what I wrote in the letter!
And all I got was that reply.
I am 100% certain that the only money that I owe is on my credit card, which is paid every single month without fail!0 -
Then perhaps send the same again...
But add:
- That you note that they are ignoring your dispute and request for any proof that you owe this.
- That you will report their refusal to provide proof to the OFT and trading standards.
- That this is now a formal complaint, and that you require a copy of their complaints procedure and a final resonse that you can take to the FSO.

No I've spoken to my bank & all is well.
I've also checked my online credit report & that is all ok
I'll write another letter and put in the above points too.

1. Has the law changed in any way regarding debt collection agencies and what paperwork/ evidence they are obliged to supply on request?
2. After five years one would have thought CapQuest had got wise to the letters published here and would have found a way round them. Is this so?
3. I had heard that if a debt is 7 years old it cannot be reclaimed and must be written off by the creditor as a bad debt. Is this correct?

3. I had heard that if a debt is 7 years old it cannot be reclaimed and must be written off by the creditor as a bad debt. Is this correct? Six years (England & Wales) without payment or acknowledgement in writing, and it becomes statute barred, meaning it can't be enforced in court. It's covered in the OFT guidelines

I am being chased by capquest for an amount of £11539.30 and although i admit this debt is mine i have not paid any of it as it was for a learn at home IT course from around June 2006 that i didnt even complete first module or any of the rest, i had not heard from Barclays Partner Finance with whom the debt was with until december 2011 when i recieved a letter from Capquest saying they have bought the debt from barclays partner finance, along with thier letter was a photo copy of a letter adressed to myself from barclays stating that they have sold the debt to capquest however the date on both letters were 22nd december 2011 which i thought was very odd, I Then recieved another letter from capquest in jan2012 saying that it was tyhe manager himself and that he has decided we qualify for his personal project that he has set up just for me and a way to pay the debt, I have since recieved 2 more letters threatening action against us. please help as i dont know which would be the right way to deal with this.0

Just an update with the troubles I was having with CapQuest.
After writing a letter asking for all the information on this debt yesterday I finally received it.
On inspection of the front I wondered how the letter ever reached me in the first place. I didn't know Saffron Walden was in Merseyside, I always thought I lived in Essex!!
I opened the letter to find a bank statement from Halifax bank.
At the top it said the full name of the account holder, for starters the middle name wasn't mine....and according to the address I was living in Liverpool!
I knew from the first letter from CapQuest that the debt wasn't mine.
So after a quick phone call to their call centre, pointing out the obvious mistakes & also that some of the transactions were carried out in Liverpool whilst I was on the other side of the world on holiday, I was assured that my address & details were removed from the system.
I made a point of saying that anymore letters or contact from anyone from CapQuest will result in me forwarding all details & lodging a complaint to the OFT.
So bottom line is, it's always worth writing a simple letter disputing the claim & also asking for details on the debt.

:(Hi I have been reading up about this company CapQuest and I have some questions involving and incident with myself.
A few days ago I recieved a letter demanding money of 180.69, for a debt I had no idea exsisted. The company was called Hellix Limited and when I rang I was shocked to find out it was a debt for a catalouge at an old adress I have not lived in for nearly five years now.
After no luck with them listening to me, trying to explain I never had a catalogue they said they would call back.
They did indeed call back 12/6/12 and the conversation was very abusive, and yes I got very upset, as I was being accused of having a catalougue with Empire that I have never had. And yet the male yelled at me as he had my name and birthdate then I was the one to pay this off.
After trying desperatly to try and make him understand that although he had half of my name right, the middle name he used was not mine, and the debt was not mine either. He called me a liar and a scammer.
He refused to tell me any details about the debt, just that it was Empire, when I asked for there number he refussed and just about managed to give me a website adress....which was wrong.
After huting for Empire catalogue I found out they have been brought out and are now K&co, so I called them. They were very helpful, and did agree there was a very old archive debt for the adress, user did use similar name and my birthdate....but said this was such an old account it was archived and not been active for over 6 years.
My questions begain to get more worried as he said the original debt was sold to CapQuest, but I have ner heard of them or whatever this debt is....and the helpful man did say he wasn't even sure what was brought as the acount was in archives.
I am worried what to do about this as the man from Hellix has threatned to get into my home and take whatever he wants, being a mum of four who doesn't work due to her childrens ages I asked hubby to help. He tried to call them and explained that not even the catalogue was asking for money from said person...that was using catalogue from adress in 2006....but I moved out in 2004. The debt people basically got abusive with him.
Now CapQuest have never contacted me, as I never had this catalogue, but now Hellix apparently has contacted me on behalf of the catalogue....which the catalgoue deny.
I am not sure what to do, there threats to me have terrified me so much I have locked the house tight, is there somethign I can do as the debt is not mine although they only have half od my name and my old address as well as date of birth. And I asked for more details from the catalogue and they are happy to help me.
But if there not asking for it, and CapQuest have never asked for it...then who are these people and what do I do, this debt is not mine and I explained this all to the catalogue and they asked for a small letter so they can help me put this into written note on the old archived account.
Can anyone help me....I am so afraid to open my door due to the collectors threat he would come to my home...any help would help sooth me....thanks.0
