Problems with CapQuest Debt Recovery Ltd

    I have today received a letter from CapQuest ... again, I am currenty dealing with them having requested Deeds of Assignment and copies of contracts for an alleged debt with someone called Citibank/Citicard they have incidently gone past the allowed periods and I have sent them the next stage letter requesting correction, compensation etc.
    However to move on to today I have received a letter out of the blue saying that I owe £13,765.00 to Marks and Spencer, I wont bother you with the details but in essence it is a statutory demand warning notice.
    I am now thinking that I may have a case of id theft but that remains to be seen but in the meantime should I send CapQ a letter requesting the Deed of Assignment, copy of Credit Agreement etc again and advising them in the said letter that they are looking at possible id theft or should I wait for them to issue the statutory demand and take it from there

    Hi, a month or so ago I received a letter from Capquest stating that I owe a few grand on a debt I defaulted on.... I sent the letter asking for the signed agreement and statement etc. I waited the 12+2+30 days (and a few extra for good measure) and sent the next letter stating that as they cannot provide me with the agreement etc I wont be paying anything etc, etc. A day later (so outside the 12+2+30 days) I received the signed agreement but no statement of account. Now as this was delivered to me after the deadline am I in my right to tell them to get lost?

    Your help would be most appriciated.

    In short no you cannot tell them to get lost! The moment they comply with s.78 it becomes enforceable again, unless what they sent you is not correct - but lack of statement is also no reason to claim unenforceability cos they can retrospectively send one at any time.

    Well....After sending the 2nd letter and bnot admitting to receiving the signed agreement, I today received a letter from them stating that they have closed the account!!!

    Surley this can't be the end of it??
  • Capquest are a notorious firm of lying bullies. The best thing is to tell them to !!!! off. They wont get the message for ages though. When people bully you into doing things they must learn they should expect to pay for it. They should also learn that victims normally get awarded compensation to the tune of many millions I believe and those who choose to be dishonest must take the consequences.

    I've just had a knock on my front door. This guy tried giving me a letter from crapquest. Told these money grabbing wasters last year that I acknowledge no debt to them. Refused said letter told this guy that I would not accept it as I have no debt with them. They say that I owe egg banking £2500, which I do not. They actually owe me money as they took £3600 out of my bank account incurred me lots of charges (which incidentally I had to pay), When I tried to pay off my £1800 credit card. That was in 2001 and now last year they start sending letters to me. I am getting really p***ed off with these jokers. They are scumbags. Told guy at door to tell them if they harrass me again I'm going to take legal action against them.
    Even if I did owe them money, it's been more than 6 years but these muppet scumbags wont quit.
  • Hi, Can anyone help me please. I received a knock at the door on Friday24th Sept and a man gave me an envelope. He explained he was from Capquest and this was a Statutory Demand for a Debt with American Express for just over £6k. I had never heard of Capquest before and took the document of him. After reading this it appears this is for a debt for a credit card taken out 12 oct 2002, for reasons of unemployment etc i defaulted on. The Stat demand states that American Express passed all rights and duties to the creditor persuant to an agreement dated 20 Dec 06...
    I have not heard from American Expresss since 2005...and cannot recall when I last made a payment regarding this debt. I called Capquest today and they where unhelpful insisting that i either pay the debt, or a minimum of 5% which i dont have, I have since checked my equifax credit report and this debt is not listed on it... Is there anything I can do to prevent this. Any help will be appreciated. Thanks

  • hi can anyone help i have debts with said companies have not paid anything yet but the problem is can they get a court order for baliffs to collect good i live with my parents and it is there home and there name on the mortgage.

    Hi Mate, sounds like 2005 your debt is Statute Barred or very close to being. You need to send them a request for the CCA and Letter of Assignment. You also need to state that they are not to send anyone round to your door and that you do not acknowledge the debt, which has to be in writing or by making a payment. If they know that you know your rights, worst case scenario is that you will be able to negotiate a more favorable deal with them, best case is that if you don't mind screwing up your credit rating, you can tell them to do where the sun don't shine.

    Crap Quest like to buy debts that are almost unenforceable for next to nothing in the pound and then bluff that they can have you hung, drawn and quarter'd. Have a search on the forum for SB and Unenforceable debts.
