Italian buyer is trying to rip me off

I sold a phone to an Italian buyer last month(6/5/07), in the listing, I made an error in listing it as including a 512mb memory card, when in fact it only had a 32mb card.

To compensate for this, I reduced the postage to the buyer as a form of compensation.

When the phone arrived to the buyer, they sent me an email (16/5/07) regarding the memory card. I highlighted to them that I had reduced the postage costs to compensate and asked if this was sufficient. (All of these emails were through ebay so can be tracked)

Now they have opened a dispute on Paypal, claiming that they have not received any goods?

Can Paypal look at the emails through ebay to settle the dipute?

  • unfortunately i didn't. I have proof of posting from the UK, but nothing else.

    Do they have a good record of feedback?

    Risky sending phones overseas, loads of horror stories. Don't think the Post office covers phones sent abroad if lost or not delivered.

    If you have kept the emails that hes sent you about the wrong sized memory card then your laughing as it will quite clearly state he has received it.

    Unfortunately, as you are not covered for Italy (unconfirmed address), they will most likely win the dispute, regardless of any tracking info, simply because you would not have been eleigible for seller protection.
    did the buyer say that they had received the phone to you by email?
    paypal are "supposed" to reveiw claims that are not eligible on a case by case basis, but I have not heard of any seller having a dispute reversed in this kind of situation. Of course if you have email proof of them saying they received it , it should go in your favour. you can never tell with paypal.

  • sending phones abroad, and that too not via a trackable method is inviting trouble.

    Paypal will now ask you is you've posted, and if so to provide a tracking reference, if you fail to do this chances are they will find in favour of the buyer.

    You can forward them all the buyers emails but I dont think they will take this into consideration, all you can do is hope, let this be a lesson, never send valuables via normal post.

    Sending phones overseas is a minefield. As others have said Royal mail do not insure phones sent overseas over £34 in value regardless of how they are sent.

    Also paypal are very strict in their chargeback conditions and an email or two mentioning receipt is NOT an accepted proof of receipt. So it seems likely that you will lose a paypal chargeback.

    You will find that very few sellers will risk phones overseas for this very reason as paypal will do exactly what their terms and conditions say in these circumstances, and the risk of getting a buyer prepared to scam you is too great to risk.
