Thanks Ame, phew, thought no one would reply. I phoned the court yesterday and spoke to a clerk who looked into the case. You are right, the Yorkshire bank had applied for a strike out with no hearing, but the judge said it could be heard in court. The clerk put a copy of their application in post and I received it today. Basically say's (I think) that they are seeking a strike out on the basis that the case discloses no reasonable grounds for bringing the claim and/or summary judgment pursuant to part 24 CPR on the grounds that the claiment (me) has no real prospect of success. Wish I could get the papers to someone to have a look at. I would like to continue in that I paid money to the court for the case, but also that the claim was in joint names and my husband has since died and he would have loved to have got something back from that bank.
Do you think its worth getting in touch with the citizens advice? I don't think its worth using a solicitor, would be expensive and claim was for £1,471. We did reject their offer of £200 prior to putting a claim in.

Okay, can you please come over to Beagles and post on the BANK CHARGES CLAIMS IN COURT SYSTEM forum - We will help you with what you need to prepare for the hearing. If you want to carry on fighting, there MAY be a costs risk of continuing if you lost as the new arguments are untested although you are in small claims so that shouldnt be too bad if it arises, by the time your hearing comes around we should have a much clearer picture of how the banks and courts are going to react so if we dont feel confident at that stage you can pull out. If you used the standard POC from here back in 07 then it is likely you would be struck out. So we can help you get together a witness statement and amendments to your POC to submit to counter the strike. We will also need to inform the court of the change in your circumstances with regards the claimants.
When you first claimed, did you get a full set of statements or transaction lists - or just a list of charges from the bank ? If statements then you will need to dig them out as we need to go through and find examples of instances where the charges demonstrate the unfairness in the relationship you have with the bank.

Dont feel on your own with these either, there is similar at Leeds and Plymouth courts too, and I suspect many more will come up as the banks get their letters sent out to the courts.

Today I managed to reclaim bank charges on my overdraft, as I felt that I was sold the account unfairly.
I made a oppointment at the bank and argued that the account was sold to me unfairly, as I was being charge £12 fees for the gold account which I wasnt told when sign up for the account and was a account that I did not want or require. The bank stopped the £12 fees and refunded all the charges that I received as I went over my overdraft due to the fees. My bank is now looking to pay back the fees also which means I should receive a further £84.0 -
I was reading up on the whole bank charges reclaiming section. I understand what is happening and I know to wait on more info. However, I was reading one part of this site that said that one could still file a claim via the ombudsman, if there was a cycle of charges, i.e. charge for unpaid d/d + charge for going over drawn + interest ~ then next month, charge for being over drawn + interest... so on and so on. Thus one can not get on top due relentless charges.
Can someone say if this is a viable route, at the time of the above, I had lost my job and could not pay into account, thus in financial hardship, however, I'm not in hardship now, but is the ombudsman route still available.

i have had a letter from natwest saying i HAD been identified as being in financial hardship they are not upholding my complaint reguarding the level of charges. it then goes on to say 'if' my complaint is currently being assessed by the financial hardship we will contact you seperately to advice me of the income, and if i hve already been accepted of being in financial hardship they will continue to work hard with me to resolve my difficulties. it also says if they do not hear from me within 8 weeks they will regard my complaint about the level and accordingly the fairness of these charges as closed. i am confused by this letter does this mean i will not get my claim and what should i do next ?? please help0

The story: Wife had been getting charged for years then I saw your (Martin's) reclaiming template letter, sent it to them, they replied they'll reply within 28 days, they replied just after, offered apology as now regulated by FSA and gave her more (with interest) than I'd calculated (with interest)?!?!?
What a result! So, on behalf of myself and my wife - THANKS A MILLION MARTIN - You really are the bestest!!!

I have a claim in with Barclays for approx £750 in bank charges, and have now received the standard letter stating that they will not be refunding the bank charges that i have complained about. I was wondering what to try next. Any Ideas? I wondered if i could argue that some people had all their charges refunded before the claims were put on hold, as a "Goodwill gesture" and why shouldn't this apply to me also. I was thinking of asking for a proportion of the claim as a compromise/goodwill gesture. Any thoughts from anybody?

I made a claim to Northern Rock two years ago. I followed all your procedures. After a number of letters they told me I was not successful as the had given me all the information
Last week a letter arrived from Northern Rock offering me over £1100 for misguided reports.

The story:
Sent original letter requesting £797.56(Nov 09), got a reply offering £192, which was the difference between the old £25 charges and new £12. Nearly accepted but read some more posts on here and got inspired! Wrote back(22 Dec 09), saying that i was not happy with the offer and hinted at the court action route using fragments from Martins court threatening letter. I said i would drop the complaint if they paid me £500 within 14 days. Received letter yesterday saying they have credited £500 to my account, checked it on-line and cannot beleive it!

I sent my letter off in 2007 to Halifax for approximately the same amount as above and recieved the typical letters : charges are on hold until the court case etc and then now after the case has finished I have received one saying I will receive nothing and my case will be closed 8 weeks after the letter if they hear nothing. How come some people who have claimed more recently are getting their money back with no problems? Do we just wait until more advise is given out and what happens if this takes longer than the 8 weeks?It seems a bit unfair that the banks can give the charges back to some and then not others.0
