My claim was with the Financial Ombudsman as i was claiming under the Hardship Rule.
My bank only offered me £105 which didn't cover the charges i was getting every week as i could not recover from the cycle of charges.
The week before the court case Halifax Bank dropped their charges right down from £35.00 each item to £15.00 each item.
I received a letter from the Ombudsman the day of the court case that they were sattisfied that although i was in Hardship that what the bank offered me was fair at that time.
If i want to accept the offer of £105.00 during my hardship i have to reply to the Ombudsman by 8th Dec.
My question is,if i accept the £105.00 will this stop me from reclaiming the whole amount when paperwork is redrawn by Martin's site or should i just not accept it?

Wondered if any one could shed some light , sent Halifax a finacial statement and all proof of hardship on 24th October claiming over £9000( without intrest) charges mainly for returned Direct debits have heard nothing obviously have chased since hearing the court ruling and they have told me they will send letters out within 2 weeks as they are obtaining legal advice of how to produce these obviously no letters. My aurgument is how can they justify ignoreing me for so long? what do you suppose they are gaining legal advice for if they have won and £9000 can they seriously state these are reasonable I feel I have been playing cattch up for ywears with my finances and after finishing uni and gaining full time work still seem to be struggling if only they wouldnt keep charging I wouldn constantly not have enough in the account to pay current Direct debits0

Hi can anyone offer advice please, I have recently claimed £1900.00 in bank charges from the Halifax Bank. i claimed i was suffering financial hardship as i was in arrears with rent payments and council tax plus other debts , i was asked to fill a financial statement in which i did and forwarded to them straight away , they then asked me to prove i was in rrent arrears and council tax arrears to which i sent proof on the 2nd November 2009 photo copies of all letters i had received from the rent office and council tax people showing clearly i was in arrears , i also sent a new financial statement as some things as changed during the waiting process which meant i was worse off then i had originally was.
i have just telephoned the halifax as today is the 14th day since my letter and was told a letter was posted to me yesterday but the gentleman on the phone was willing to discuss the contents of the letter to me over the phone , Basically they have said i am not in financial hardship and are asking there debt managment team to contact me to discuss my debts and offer advice . as anyone ever come across this way of dealing with a claim and what advice can anyone offer on what i do next PLEASE HELP thanks in advance Neil
I am also with Halifax, they are the worst.
They agreed i was in financial Hardship with all the charges they levied on me at £35.00 a time, they also told me their Management Team would call me so i called them instead.Got a really nice girl who after going through everything with again also decided i was in Financial Hardship and there was nothing they could do for me.
She said she would let them know and they would come back to me.I was claiming £5000 back in charges and the bank sent me a letter saying as i was in Financial Hardship they would give me £105.00(That doesn't even cover a weeks worth of charges from them).
I sent a letter to the Ombusman about it who said they were chasing them again as they had not heard anything,to cut a long story short, they came back to me the day of the court case saying they were offering me £105.oo still and the Ombudsman agreed this was fair at the time.
Halifax were just dragging them all out till after the case so they wouldn't have to pay out what was due.
It's very funny that if the banks didn't think their charges were unfair, why did Halifax a week before the court case suddenly drop their charges right down from £35.00 to £15.00 per item and hasn't put it back up again.
Maybe the court should have looked at that.
Maybe we could all get a share of the bankers bonuses:rotfl:
I have accepted the £105 for now but as soon as Martins new templates are published i will be right back at them.
Then i am closing my account with them for good and any bank associated with them
Keep going Martin,your brill :money:0 -

Hi all can anyone please tell me if it is still possible to claim under the hardship rule ? sorry if this has been answered already but my bank seem to be sending me all over the place saying the will waiver upcoming charges then not doing it and denying it when i call them back, have now sent a letter to FOS to see if they can help, any advice greatly appreciated, I received a list of charges back from my bank the day after the court ruling and it totals up to about £6k on one account alone.0

I've been claiming hbos since feb '07 before the waiver was put in place for £9500. i ve since went into hardship and all they offer is the debt management scheme. took it up with the ombusman and he said there's nothing they can do so i've called the consumer credit counciller to see what they can come up with. my point is that how can banks pay out to people who were not even in hardship before the waiver yet turn down the ones who need it most!0

Bank: Halifax
Amount Reclaimed: 5000.00
Amount they paid: 2400.00
How long did it take: since July 09
The story: They paid this amount into my bank account last night, since I've had my case looked at by the customer services they have been excellant in helping me, first phoned them at begining of Nov 09 thought that after court case they would not help anymore but nothing was mentioned about case at all they just continued as normal helping me.
The only thing was that they would only go back 6 years and my claim was from 2001, but i really thought it was all lost, but now can have a great xmas knowing there will be no-one knocking at my door (only santa)0 -

Well HSBC were paying my charges back in monthly amounts under financial hardship and I just phoned today to get this month`s payment and they said they no longer have a financial hardship team as the courts ruled in favour of the banks.0 -
