    I reclaimed from TSB in 2007, £1958 took until 5 days before we were due to go to court and they just paid the money into my account without tellling me.
    They first offered me £250 as a goodwill gesture to drop the case, which i refused.
    I really hope its good news for everyone else tomorrow, Good luck all!!
  • Hi just to let you know I received £663 back for bank charges this morning 24th November after just two phone calls ( they didnt even need me to send them evidence of charges) to Barclays claiming financial hardship 6 weeks ago they owed me £1000 but have agreed as this is a goodwill gesture I would still get the rest back after the court hearing. So CLAIM NOW this has come in handy to pay off some bills:j:T:money:Thanks Martin

  • Hi I wondered if anyone could help Im in the middle of claiming back over £9000 back from Halifax through hardship I sent the financial declaration in with eviction notices ect from the mortgage on 25th October. I rang at the begining of the week and was told it was being looked at again on the 27th and I have now heard the news that the banks won today . Is that it now does it mean that we can no longer claim. Im sorry if I sound confused but I am
  • i am in the same position as you i have claimed under financial hardship after losing my job and have been pushing the Halifax for answers i have filled all the forms in they asked me to and supplied all letters of proof of rent arrears and council tax arrears all at the beginning of november and still have had no reply by mail, I contacted them by telephone on tuesday and they said a letter had been posted to me on monday saying i wasnt entitled to anything as they dont believe i am in hardship now my argument is this ...... I sent all the letters off on the 2nd November 2009 and told them they had 14 days to respond to which they still havent , so in my opinion they have deliberately stalled on there decision and played dumb to see what the result of the test case was which we all now know as gone slighty in the favour , now can anyone offer some advice on what i should do now or is that it have i lost because they failed to respond within the 14 days which they are supposed to respond in thanks in advance Neil

    Just to further add to this The letter they have alleged to have posted on monday still hasnt arrived and its now thursday ??????

    Amount claimed: £1589.97 (including interest of £289.97)
    Amount paid: £956.25

    Originally claimed April 2008 but like everyone else the claim was put on hold. Re-started claim as a hardship case in September 2009 after being made redundant.

    I did feel that they were deliberately delaying having to deal with my case until after the court judgement as they kept claiming that they didn't recieve any of my info even though I sent it several times. Phoned the customer services and threatened to invoice them for my time and sent info recorded delivery. Recieved a letter confirming settlement that was dated the day of the court judgement.

    I have several accounts with Barclays including morgage, loan and savings and a current account well in credit (thanks to my redundancy payment) so was amazed they came through especially after the court judgement, dont think I will be quibbling the amount as its very welcome in time for christmas. Dont give up, if you have a hardship claim going through keep pushing them!!!!
  • I did have a hardship claim going through but they are now saying i am not in hardship and have rejected my claim funnily enough the letter arrived after the court case , they have just dragged there feet all the way on mine and now cancelled it after the result THE WHOLE SYSTEM STINKS that they can delay to such an extent that they get out of paying

    i woudl like someone to help with claiming back these bank charges i have filled in the letter and worked out how much ive been charged and it comes to £1032 i just wanted to know what the process of sending the letter and what should i expect

  • I need some advise after the court case.
    My claim was with the Financial Ombudsman as i was claiming under the Hardship Rule.
    My bank only offered me £105 which didn't cover the charges i was getting every week as i could not recover from the cycle of charges.
    The week before the court case Halifax Bank dropped their charges right down from £35.00 each item to £15.00 each item.
    I received a letter from the Ombudsman the day of the court case that they were sattisfied that although i was in Hardship that what the bank offered me was fair at that time.
    If i want to accept the offer of £105.00 during my hardship i have to reply to the Ombudsman by 8th Dec.
    My question is,if i accept the £105.00 will this stop me from reclaiming the whole amount when paperwork is redrawn by Martin's site or should i just not accept it?
