Tesco ticket-disabled father
sabrefitz
My 88yr old father parked in Tesco's car park today in his specially adapted disabled vehicle, which carries a wheel chair in the back with the disabled person sat in it - so it is clearly a disabled persons vehicle.
He parked in a disabled spot and forgot to put his disabled badge in the windscreen.
You guessed it when he came back there was a parking ticket on his windscreen from a PPC asking for £60 fine within 28 days then it goes up to £100!
Well he is 88yrs old and is panicking like mad..what should he do ignore it, appeal, pay or what?
From what I can gather writing to the PPC is a waste of time as they are only money grabbing.
Whats this Protections of Freedoms Act 12? does that mean that if he ignores any correspondence from them as to who left the vehicle there they can just claim of the registered owner (my dad)?

Ignore it and write to the manager of the Tesco concerned telling them you will no longer be shopping there.0
-
No need to panic, and do not pay these despicable scammers anything.
I'm sure Coupon Mad will be along soon to tell you exactly what to do, she loves getting her teeth into this type of thing, and she really knows her stuff.0 -
Been along already and posted on pepipoo as SchoolRunMum!

''Oh God, where do I start? This is an illegal ticket as it breaks the Equality Act 2010.
First thing is for you to take the receipt and the ticket to the CS desk of Tesco on your Dad's behalf and demand to speak to the Store Manager. Not the Duty Manager and not the teenager on the CS desk - ONLY the Store Manager. Then tell the Manager what happened and ask them to cancel this one.
Highview perhaps, or Euro Car Parks? He must not panic nor pay. As I said, this is in breach of the Equality Act which is what you need to tell the Tesco Manager unless he quickly cancels it (Tesco can).
Come back in the week and tell us what happens, because if need be I can write you an appeal to win it either at the first stage (to whoever the PPC is) or later at POPLA where I would have great pleasure in helping you beat this. I used to be a Disability Advice Manager and have written a few of these appeals for people - I do know the law in this regard.
But start with that Tesco Manager and be assertive but icily polite. Take the ticket AWAY from Dad right now so he doesn't lose sleep nor pay it, and tell him you are dealing with it to cancel it for him and he need not worry another jot. ''
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks for everyones replies re this!
Update......I called into Tesco and spoke to the manager who said they have no control over the car park and cannot help. He is probably right because the car park is for the shopping centre not just Tesco.
I emailed the land owners and the Managing Directors PA replied the same day saying she had been in touch with the car parking company and the ticket has been waived!0 -
Thanks for letting everyone know the outcome.0

Great result for you
further proof that going above the parking company can work When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Excellent result OP - hope your father feels the pressure is now off him.
What human being with half an ounce of intelligence would ticket such a clearly adapted vehicle for a disabled person parked correctly in a recognised bay? Answer - your average PPC parking chimp! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

What a stunning piece of work C-M. As Hovite suggests this should be a sticky.
Edit: I've submitted a request to CrabmanMy very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).
For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com0
