Well let's see what B&H Council think of Aldi's latest attempt to scam it's customers !

"Aldi originally gained planning permission for this store with the planning condition that they supply park for shoppers using any of the local stores for 3 hours. Since that application, they they agreed to conform with, they have successfully got permission to reduce the time to 2 hours. This was after them being fined for breaking the original condition. They also attempted, without asking, to change the right to park there to ONLY their customers. They were forced to back down after a complaint by myself.

The original 3 hours was instigated to support other local retailers. The subsequent reduction to 2 hours hit local retailers business. A further reduction will make it virtually impossible for people using the car park to use any other retailer after using Aldi.

It is already difficult for elderly and disabled people to do their shopping in the new proposed time limit, partly due to queues at the tills.

The original planning permission also included the condition to manage the car park in a way agreed with the council. Originally this was with an attendant on site - subsequently, and it would appear without council permission, this was changed to an ANPR system. This disadvantages those who are disabled.

An ANPR system doesn't manage parking, it doesn't even measure how long a car was PARKED for, it just measures the period of time between a car passing the camera twice. It doesn't stop abuse of disabled spaces and so can't be classed as a management system that was originally agreed by the planning permission.

This doesn't even take into account that the agent Aldi have employed, Parking Eye, issue "tickets" ( really known as invoices ) to those using disabled bays validly completely against their own trade association rules ( British Parking Association rules ).

In addition, Parking Eye have been proven to be bullying and litigious and to continually ignore industry best practice and their trade association rules. They also regularly break the Protection of Freedoms Act ( Oct 2012 ).

It seems wrong that a commercial business can agree to original planning conditions and then gradually erode them for their own benefit but to the detriment of the wide business community and therefore residents."

Aldi have been caught out in Portsmouth, trying to change the rules to not allow drivers to leave site.

Although not parking eye, but UK parking control. Shows how money grabbing they are, if you got an illegal ticket they won't write to cancel it or give refund if paid, you need to still appeal. Which the silly sods will still reject.

Not the best article with the f word mentioned.

‘People who have been fined previously for leaving the site under this time will be able to appeal for a refund from UK Parking Control who manage the car park.’

UK Parking Control did not respond to calls from The News.

The chances of a refund from UKPC are somewhere between zero and zilch. I think I'd be going after the Principal in this case. UKPC coughing up the odd £100 is one thing (even with the new 'rules' there's plenty of fish in this barrel for them to shoot), but get the Principal up against the wall is a more devastating strategy that could see UKPC shown the car park exit sign (hope it meets BPA signage requirements :rotfl:)

And why am I not surprised that UKPC did not respond to calls from The News?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

This is when the MP who put pressure on the managing agents should put more pressure to get any tickets cancelled/refunded.

UKPC giving money back? Is that a pig flying?

As soon as somebody stands up to these bullies they cave in and cancel a parking charge,:-

    http://forums.pepipoo.com/index.php?showtopic=82817&hl=

A few weeks ago I mentioned that Parking Eye/Aldi were breaking planning laws, original planning consent was for 3 hrs , this has been "whittled" away over the years

Aldi's facebook page and their link to customer services , just produced a reply from 2 dragons, so I emailed their MD and also their PR company, with a suggestion of planning laws and possible rateable values for charging.

Phone call Tue morn , and I mentioned that my wife worked for "Johnson press" (evening newspapers in most towns) , and a simple email could get possibly 150-200 reporters doing FOI requests!

    seems to have worked
. See how the big boys fold.
