    The point of being given permission by the retailer is that as far as you were aware it's their car park so if they give you permission then that's final. The car park is not owned by Parking Eye so they are merely the agents of the retailer either directly or via the retail park managing agents.

    Well they wont have any of it and said all they can do is emsil me cinfirming I was bringing an item back to store but as far as where we parked cant get involved.

    As I said pop them an email demanding the popla verification code. I'm guessing here but parking eye only have cameras on entry/exit so its not likely for parking in a disabled bay. We can go through popla to get this won for you.

    It won't be using mitigating circumstances like you've done already. The appeal will be on their legal right to issue scam invoices. So please send the email asking for the code as its your legal right to take this further. They have the RK details now so just write to them admitting nothing.

    It may help someone with a serious disability if the OP decides not to be such a selfish idiot in the future. Is that a problem?

    In the two photos on the letter it has us parked in the didabled space. My first appeal was trying to explain why we had to do this, as I say when they replied asking for name and address to process the appeal I ignored so should I just do a fresh appeal as if I hadnt done one before? Thanks alot

    The OP wasn't selfish there was a perfectly legitimate overriding reason for the disabled space to be used for a few minutes so he could unload. He was given permission by the retailer.

    A disabled space in a retail car park is not sacrosanct & there needs to be common sense here. If a delivery van needed to unload a large item for the front of the store they might temporarily take up all the disabled spaces. If a car was collecting someone who had fainted in the store who was wobbly on their pins they could use the disabled space for the short time necessary.

    We don't even know if there were other unoccupied disabled spaces. Even if there weren't if during the short time that the OP was occupying the space someone else who had a legitimate reason for parking there arrived then what's the problem with having to wait a few minutes until the space was clear just the same as if there were a delivery van there?

    No appeal, just demand the popla code. They are writing to the RK of the vehicle. Tell them that they have 35 days from the original appeal to give you the code, per version 2 of the BPA Code of Practice. If they don't supply you what the code within that time frame they are deemed to have accepted the challenge to them.
