Major problems with car.. One garage blaming the other& vice versa. Where do I stand?
Hi all.. I need some advice.... And quick please. 
Basically.. I bought a car, like my old one but newer and different colour. Peugeot 307 estate. My old one is a silver HDI and it's getting old now and things are starting to go.. I had abs light and air bag lights that would prove Costly to fix, Due to new legislations in mot passing etc.. Plus air pollution fault kept coming up on dash and someone told me that possible cat /dlr? failure was imminent due to the car intermittently spluttering .. However I love these cars and the peugeot diesel engine is one of the best, and decided to look for another.. .. I found one.. In lancashire, In white and 5 years newer and £100k LESS Miles.. Full mot, freshly serviced FSH, just had new turbo.. Excellent i thought. And I parted with £2,200 over the phone on partners credit card. I had the car delivered. Due to the distance of the car garage selling it (200miles from my house) it was driven to me. The car was driving fine.. But compared to my old one it seemed very sluggish.
Now I had my old 307 estate HDI remapped about 7 years ago so put it down to this and started looking around for someone to do the same and remapp the new one I had bought.
On day 4 after getting the car.. An error message 'DePollution Fault' came up on the dash. ..u can imagine my horror.
I rang the garage asked them what the hell they thought this was and I wasn't happy that this was doing it only after 4 days. It would reset itself then a few more days later do it again.. Eventually after the week the car would not go over 60mph. The person in question couldn't tell me and confirmed it would be best to get it diagnosed.
I went to a local garage that offered diagnostic checks .. one that I haven't used before, who charged me £25 for a diagnostics.
3 error messages came up, 2 mentioned EGR valve and one said air flow problem.
The garage quoted me £90 for EGR valve soaking or £250 for new.. I asked them to try the soaking first, they did but said after soaking it in chemicals over a whole weekend it was still stuck solid and I would have to have a new one. I wasn't happy but just wanted my car so authorised them to get it fixed ASAP. and decided to take the cost on the chin. I was a bit embarrassed that I would have to do this after only haing a new second hand car a short while that was promised as 'perfect' to me.
They did the valve and asked me to come down to the garage.. On arrival they told me the new turbo on the car had gone and that would need doing as well! Being a woman.. I wasn't sure if they were trying it on, so the mechanic urges me to look at the turbo and inside is a little nut, wedge were apparently teeth inside should be and the teeth are now no where to be seen.
Well I haven't a clue I am not a mechanically minded person. I inform the guys I only had this car a fortnight tops and that it was supposed to have a new turbo. He did confirm the turbo was new, there wasn't a spec of dirt on it and he suspected failure due to faulty part. And that the new turbo should have been fitted with a new feed pipe which they havent done cos he could see it was an old pipe. Apparently they can crystalize? Or something? When I asked how much to now get the turbo done as well.. He explained that when they do a turbo they do everything as a precautionary measure like feed Pipe? And other stuff because that's their work ethics.
I told the mechanic well I don't feel it right that I should pay for a new turbo and told them to hold on the car whilst I contact the original garage to tell them what's happened.
It took me another two weeks to argue the toss with the original garage that the turbo that was supposed to be new on my car had gone and for them to finally send me another to replace it.. But they made me pay a deposit of £100 on the grounds I would send the old one back (turbo number1) so they can look into why exactly it failed and why there was this bolt lodged inside it.
All this time passing and I get confirmation from the garage that had my car sat up on the ramp waiting.. That they would fit the new turbo if the original garage sent it. but due to not a part coming from them they couldn't guarantee it..
Well I said that's fine, I agreed that I understood.. But it was coming from a supplier, just the same sort of parts supplier they use so it would be fine and brand new. And it was when it arrived.
My partner delivers the box that arrived to the garage so they can fit it.. On handing it over, apparently one of the guys says to him.. "is that it?" like expecting there to be more.. But he says " well yer that's a new turbo apparently so that what I bring to u to be fitted"
This was last Friday.
Tuesday morning I get a call from the garage who has my car..
I get told the new turbo is fitted but after an hour of running the car the new turbo has GONE!!
I was like !!!!!!.???
I was told the car must have underlying issues that keeps casuing these turbos to go and that i should go back to the original garage i purchased the car from...
And got onto the original garage.. They were as go smacked and angry as I was.. I couldn't fathom now what to do.. But they basically said they would not be sending out another as its highly improbably that two turbos are faulty and blamed the garage on incorrect fitting to cause the failure or new turbo number 2. ?. And completing not agreeing to talk about the reason why turbo number one had gone til they saw it in the flesh after tests they wanted to do.
On speaking again with the car garage local to me that had the car, I was I tears, asking them what had happened and why this occurred? On Probing Further I got informed all they did was fit the new turbo which they told me to get.. They have not put on a new feed pipe or anything else that they would normally do in their work ethics if I were having the new turbo from them. All they did was fit a new turbo part that I got from the original garage.
Because that what I asked for???
I was just doing what I was told and following instructions!
Now after days and days of arguing with both garages.. Either one is willing to hold their hands up.
I am in the middle of one garage saying the other garage is trying to pull the wool over my eyes and vice versa.
Original garage said the feed pipe (if ATALL this is the problem the new turbo number 2 has gone again) would have been checked and fine at fitting of new turbo number 1.
And that if garage that had my car already mentioned to me that they do new feed pipes .. When fitting turbos.. Why oh WHY did they not do this job ethically like they claim to always do when they supply the turbo part? Which I consequently put to the local garage ..
Their answer is because all i said was fit the turbo.. I didn't mention the feed pipe..
But I presumed the feed pipe would be done automatically after being told that in their work ethics on fitting turbos that's what they do as a precautionary measure.
So I am stuck in the middle.. With each garage blaming the other. No garage willing to ring and talk direct to the other.
I am the tearful go between and I think cos I am a woman they can all get one over on me.
I am so sorry this is long.
Now as I stand today (sat 1st June) car was delivered some 8 weeks ago.. I've already spent money on it and changed over my alloys from old car and lights, accessories I bought and taxed it etc..
All I want is my new car back on the road!
But where do I stand with each garage?
Worst case scenario is pay for the EGR valve, take it to another garage to get another third turbo fitted, this time with feed pipe, and stomach the cost of however much.
But why should I??
I have to call back on Monday to speak to the boss of the garage that has my car... Cos they basically telling me that I have to come and get the vehicle, pay for the EGR valve work and they want shot of the whole situation!
The original car garage advises me not to collect the vehicle cos then I don't have a leg to stand on with regards to them mis diagnosing the fault or not fixing it properly.
I have two turbos that don't work. Number One still needs to be sent back for my £100 back! And a car that wont run correctly still after all this.
But they are not willing to send out another as they believe it's the garages fault that it went again .. But the feed pipe problem is the only suspicion.. No one actually knows that's the reason why the turbos keep failing.. And I am a woman.. Not mechanically minded in the slightest. So I have no clue.. Just being fobbed off from every angle.
Please help me someone .. I don't know what to say to make either garage listen to me.
We have already started a claim through barclaycard for our money back.. So glad we used that to pay.. As the car was not fit for purpose.. But that may not come through if i have already had work done on it.. And it can take up to 6 months??
But I don't want my money back really I just want my new car to be road worthy, and drive not in a sluggish fashion! Without having error messages come up on the dash. And not costing me anymore money!
( apparently the anti/de Pollution faults with these are a common problem. ) be easily fixed? Well I dunno. I am at my whits end.
Is there a code of conduct or a breech or contract or something that I can quote to the garage that has my car?
Someone said they must not let the car leave without it being road worthy.. Apparently it drives but again not over 60mph but this time there's thick black smoke coming out of it.

Please advise me what to say to the garage on Monday when I speak to the boss not just the mechanic.. Cos all I got from him after him putting the phone down on me several times.. Was he just fit the new part (turbo number 2) cos that's what his boss told him to do.
Omg I could cry again
Is it either garages problem?
Can I sue them if I take the car to get repaired elsewhere?

Also let me add.. The original car garAge bosses have said they are not willing to spend anymore time or money getting this sorted for me.. And will not be giving any refunds for the car back.
(that's what prompted me to call barclaycard and start a claim under section 75 of consumer credit act. )0 -
personally I would get rid of the car and get another, take it back to the original garage and demand a refund, it is not in good condition, if they do not contact the credit card company and get them to sort it0

I may be missing something here, but de pollution fault usually refers to the DPF (diesel particulate filter ) in need of regeneration.
On cars with DPF's fitted they need regular long runs at higher revs ( over 3,000 rpm ) to enable a regeneration to take place.
If this doesn't happen the car can go into 'safe' mode and performance and fuel consumption be affected. In a worst case scenario a new DPF may need to be fitted ( this can cost up to £2000 ).
If you do take the car elsewhere , don't tell them your saga just say it's not running right and ask for them to do a diagnostic check.
They won't want to get involved if you tell them everything.
You should really have returned the car for the seller to fix but now that work has been done elsewhere you are in a bit of a black hole .
The seller has accepted the word of garage 2 and sent a replacement turbo ( was it actually at fault ? ) , if that diagnosis was wrong then the issue really lies with garage 2.
The seller is already out of pocket by trusting garage 2.
The turbo hasn't fixed it so it appears their diagnosis was wrong or they didn't state that the seller should send a turbo and the associated parts that would normally be fitted.
I think there has been lack of communication throughout, but where does the blame for it lie.
I am not a mechanic, but if someone handed me a turbo and said 'fit that' then that's what I would fit.
Possibly a diagnosis elsewhere is the way to go but whatever you do will not be straightforward....Good luck !0 -

This is what should have happened in the first place however it would appear to be in a worse condition now that garage 2 have done their worst.
It needs re-instating to the condition it was bought in first.
The seller is not responsible for the butchering that appears to have taken place due the OP taking it to garage 2 and not returning it to them.0 -
Which engine is it and how old?
I had a 2004 307 XSI HDi 136 and had nothing but problems in the last year of ownership.0 -
Thanks to all who responded so far.. It's a 2007 307 sw 1.6 16v (new one) older one my original was 2002 307 HDI style 1.4.0

I'd be very cautious about considering fitting a third turbo to the car after this.
It's obviously some underlying issue with the car and there's no guarantee swapping the feed pipe will make any difference.
If the turbos are failing due to oil starvation, then that normally is something that might be the cause of the oil feed pipe. It could also be it's not had a good service history and some of the oil has thickened or has sludged up. I've this happen where the feed pipe was changed and the sludged oil that's inside the oil ways in the engine, block the pipe again.
That type of fault is usually for beyond economical repair for most older cars.
But when you said some blade type things were missing and lots of black smoke, thet sounds like the blades from the turbo have been damaged. That's not the result of an oil feed pipe to my knowledge.All your base are belong to us.0 -
its the DV6 1.6 engine that has had continuous problems with turbo failure and is also the engine that is fitted to the ford focus.
it has a history of ripping through turbo's because of other faults with the system that were present at manufacture but pug nor ford will admit to it, although now pug cit and ford offer a upgraded version to the faulty parts wich requires a almost full engine rebuild to replace them.0 -
Are you saying you paid £2200 for a year 2007, diesel 307.
That's seems very cheap to me. You say it had done 100k less than your old car.
How many miles had the 2007 done when you bought it?0 -
