Major problems with car.. One garage blaming the other& vice versa. Where do I stand?

And they cannot sell my car.. That is THEFT. the definition of theft is to permanently deprive the owner of an object.
Actually, the sales of goods and services act makes its own provisions for holding goods in lien of payment.
If it remains uncollected there is a procedure they can follow if they wish on treat it as abandoned goods. This procedure is covered by the OFT and involves sending two notifications of their intention to dispose of the goods - they can then deduct their costs, including the bill and return any remaining money to you.
However if the debt is in dispute there is nothing stopping you 'paying under protest' and seeking to recover the money via small claims court. And the obvious fact if a judge decides you are not liable for the bill they could be liable to you for the cost of the car.
The police would see this as a civil matter, not criminal matter. Unless your suggesting your husband would bend his colleagues arms and that of CPS?0 -

I wasn't suggesting anything but naturally I asked his opinion on what would happen if I did this... Or if they did that.. In teh eyes of the law regarding theft..the last thing I want to do is get into any deeper waters about this whole messed up situation. I am sick to the back teeth of it I feel like just going down there paying the garage then sending them a lovely packet of dog poo in a Tiffany box.. Lol.. ( I have also been advised that this is illegal) haha
So now.. In this situation.. Would u just go and get the car, pay the garage 2 for EGR work.. And leave with car not running and broken turbo?
Then what would u do.. Bring the car back to seller garage? (some 200miles from my house) or hold onto the car on driveway until I hear back from Barclay card? And take the £300odd bill for EGR valve work on the chin?
There's no point in replying "well I wouldn't have got into this position in the first place blah blah.. " that's doesn't help.. Just tell me in one sentance what you would do if u were me now.... Please.?.0 -

and send a recorded letter to garage one rejecting the vehicle and inform them that you have applied to CC comapny for a S75.
they are to collect vehicle from you home, and refund you card.0 -

theres no template, youd have to research the SOGA (sales of good act)
i would also go upto credit card board and ask about section 75 to proceed with the CC company.
i would also swalloe your pride here and apologise to the second garage, and ask them to do a written report of the iengine failure and ask them if its in their proffesional opinion the the defect was there prior to sale.
once you have the garages report enclose a photocopy with your letter.
within your letter you must state reason in legistlation why you have rejected the vehicle, what you want to happen I.E a full refund with out of pocket expenses such asd the egr valve, recovery of the vehicle from the garage number 2 insurance costs and tax costs.
they have 14 days to collect and refund.0 -
