    Well... its about time someone got fined.... Doesn't matter what u throw. ANY LITTER is an offense, even if its not on the road. Pay for it, and tell everyone u know that ppl are on to u.


    EDIT: Stop trying to side step things with hedgehogs! The situation is clear. Just dont litter!!!

    If someone points out that there were no hedgehogs, she could reply that that was because not enough people feed them.

    ... or maybe because the last one was squashed under the wheels of a car whose driver was eating/lobbing an apple and not looking where she was going!

    I've thrown food into the ponds near where I live. There were loads of others doing it as well.

    It's called feeding the ducks.

    Chucking an apple core onto a grassy verge on a dual carriageway is no different, really. It's hardly chucking discarded McDonalds wrappers all over the pavement, is it?

    well in the eyes of the law & many members of the public (& MSE, it seems!) it is the same - littering. Littering isn't dependant on what you are throwing but the fact that you are throwing

    i didn't say that - if you look at what YOU wrote, the last line was:

    oh and incidentally if you must feed the ducks, feed them with vegetable scraps. bread is not very good for ducks - just because everyone does it, doesn't mean it's good!

    Exactly, and is the point I made. Speeding has potential to be more serious, as does littering. Until that event occurs, its the basic offence.

    Seriously, if she is fined for this, then what is next? Kids being fined for feeding the ducks?

    She should elect to go to court. I very much doubt that they they would pursue it that far, and the magistrates would not be too impressed it they did.
    If I were to take a dump in your garden, could I not say I was merely fertalising the lawn, it does after all bio-degrade, should you complain that the garden has no lawn as its concrete I could argue that is because not enough people are poppin over to squat in it.

    I agree with Ben, (although I think a caution would have been adequate for a first offence), but what if everyone threw apple cores on to the grass verges - we'd never be able to open our car windows for the stench of rotting vegetation. Everyone seems to have missed the other point of this story which is that the OP's niece could have found herself with a fine for eating the apple whilst driving had she been spotted doing so by a police officer.
