    Agree with OP the fine is totally out of proportion to the offence; a caution by letter would suffice.

    Personally I wouldn't pay it and let them take you to court; I would be surprised if a magistrate upheld such a fine.

    And I'm sure I remember a big hoo-har at the time when a woman was fined for throwing a Quaver out her car window

    This kind of behavior from local councils is unblievable!

    Your probably supposed to take it home and put it in your foodwaste recyling box, then wait for it to become infested with maggots and flys before the council come and empty it. But then, they probably wont, beceause you havnt seperated the twig and leaf that was in the top of the apple into a seperate garden waste bin.

    Its the councils that should be getting fined if you ask me!!

    I would be asking for proof that it was me driving at the time as multiple were driving the vehicle that day and I am unsure as to which person it was.

    I don't think they would be able to tell you who was driving, or even if it was a male or female when moving at that kind of speed, and so they surely wouldn't be able to make it stick.

    For reference though, throwing stuff out of windows is dangerous, motorcyclists do get hit quite a lot (I have on the back of my Dad's bike... its not fun).

    Has your neice responded to the letter? If not, she could (not should) reply that she was not the driver of the vehicle and that they should take the matter up with the driver.

    As to the right & wrongs of the incident, I think recycling apple cores should be encouraged, but taking your attention off driving a vehicle should be stongly discouraged.

    Come on - the OP said that her "neice knows she did this" - you suggesting she lies? That's not really in the spirit of :money: is it?

    The real question is why did she feel the need to lob *anything* out of the window - just pop it in the ashtray (or wherever) and into the bin at home. I HATE :mad: :mad: :mad: littering of any kind - even if it is "biodegradable".

    It was on the news in the week that Littering officers (well people who pick up litter) now have powers to produce fines for any littering offences. This would include throwing an apple core on the floor.

    I think she should pay.

    I have mixed feelings on this, I find littering utterly irresponsible and agree with penalties, but again I find it hard to throw any foodstuffs into the bin, if it can't be fed to wild birds then it can usually go into the compost bin, if I am out I will usually toss something like an apple stump into undergrowth for the wildlife to forage but never any processed food.

    But NEVER from a moving vehicle pay up.

    What if the wind had caught the apple core and it landed in another drivers view. Causing them to swerve and crash? I know it may be unlikely but you never know.
