    Shopfitters are persecuted by the police.

    Its shoplifters, but ideally it should be the Guiness Book of World records since they have such amazing strength.

    In that case, the drivers should be charged with a proper offence, should they not? If it really is that serious, it should be dealt with by the Courts and not by way of fixed penalty notice for simply littering.

    I couldnt agree more, anyone caught littering, should be charged with a crime of at least vandelism, and should be made to serve community service, which involves cleaning up everyone elses mess, up until they realise what littering actually is.

    Only if it actually causes an issue. If it just has the potential, then its littering.

    Why?

    You can be charged with dangerous driving if you're driving at a stupid speed, even if it does not cause an incident, just because the potential for an incident is there.

    Apples are evil.

    I wouldnt blame the OP I would blame the apple for not being juicey enough and for having a core.

    I suggest we should push more money into genetically modified foods and create a coreless apple.

    I don't really know what the argument for not paying the fine can be since she did do it and the biodegradability of what was littered isn't a defence. Keeping with environmental laws, fly-tippers can't excuse themselves from their activities by claiming the wood they dump eventually breaks down and I doubt it's any different with littering cases.
    i dont understand why trees overhanging public highways are not littering also.

    I don't think we can send a penalty notice to a tree for something it does naturally:P - although we should give it time because I'm sure the government will get that desperate at some point. Birds have droppings - they're forgiven for not being able to abide by the law like I have to - I can't do my "droppings" on my neighbour's car like they can. It could go on and on - forest fires are naturally occurring things but if we start it, it's arson. When the council should be doing things like trimming back trees, collecting leaves etc and they're not, then we have to tell them so.

    People can only be charged with what makes sense in law and, in law, littering isn't the same as vandalism. I agree that for many crimes, I would like to see people out making the community tidier rather than just being fined so officials are meeting their targets. We'd see the benefits quicker at least I suppose and it may change behaviour especially as a lot of people who are fined may have no problem paying out thousands in a year if they're rich enough whereas actually getting hands on in the community might be a right shocker!

    Was she disposing of an unwanted apple core, was she maybe feeding the hedgehogs?.

    If someone points out that there were no hedgehogs, she could reply that that was because not enough people feed them.

    Seriously, if she is fined for this, then what is next? Kids being fined for feeding the ducks?

    She should elect to go to court. I very much doubt that they they would pursue it that far, and the magistrates would not be too impressed it they did.
