No. It won't succeed as an appeals point. However, neither will anything else with PE. Feel free to use it in the "weak" appeal to PE. But when you get to POPLA, you'll need a lot better, which, with the help and references available on this forum, will be easily achieved.Is the fact that people are being charged for parking in supermarket car parks out of trading hours a valid point for not acknowledging receipt of pcns?0 -

Your posts are very odd. You start off knowing nothing, then suddenly and weirdly assuming the person should pay (LOL!!!), then suddenly understanding about POPLA.
Parking Eye eh? If you are a plant then get a real job.
If you are genuine then this is now my new standard reply about any PPC as I am struggling to type the same thing again and again, answering new threads every day saying the same thing as the last thread.

Put these words in 'Parking Eye appeal'.
Click to change the search to 'show posts' (NOT left at the default search 'show threads').
Read threads from the last month or so - and then challenge the fake PCN without naming the driver. Let us know the reply. Guy's Dad was simply explaining that your version of an appeal would FAIL (but ours wouldn't, so more advice on the POPLA stage is imperative to win this).

Actually, being the poster that you originally replied to, I understand that you misread my post. Sorry it was brief, but I was on my tablet, no my PC.
I understand you are bona fide and have got it that the PPCs will reject anything, even most valid reasons as it is money to them.
Use Stroma's brief appeal letter to them so that they don't get into a discussion chain with the that erodes your POPLA window. Do in the belief that it will be rejected.
Then, when you have the POPLA code, come back on here for some advice on what to include. I as making the point that POPLA have a very tight set of appeal categories and that your post saying appeal on the principle that out of hours was wrong is a waste of time as there are no principles in the Parking Industry!
You need, for POPLA, to challenge the right of the PPC to levy charges, to catch them out when they fail to follow the BPA Code of Practice or POFA. Guys on here and pepipoo are building up information on what constitutes a winning appeal with POPLA and the frustration that regulars have is seeing people who have screwed up their POPLA appeals by not coming on here first for help.
I am sure you are not a troll, PPC stooge and expect to see you back in a couple of weeks for help with POPLA.0 -

the path to take would be to appeal - based on the principal alone. There has been no loss of income after all...
Also there has been no income either. Has it not occurred to you that the car park is provided for customers of the supermarket and nothing more?
Question needs to be asked, how often do you park there and how long for?
And before anyone thinks I am pro PPC's, I am most certainly not. But if the OP parks there on a regular basis then IMHO that amounts to trespassing.PLEASE NOTEMy advice should be used as guidance only. You should always obtain face to face professional advice before taking any action.0 -
