Oh PLEASE! Scraping the bottom of the barrel springs to mind!

First of all, if you wanted to regularly park on the car park, then I think any normal rational person would go see the store manager sometime when the store is open to get permission? Also, most stores I now have a telephone.
Who said anything about parking regularly? As the stores are shut there is nobody to answer the telephone.

As for the "Under the Countryside and Rights of Way Act 2000" bit... I havn't come across many supermarket car parks that are "on open uncultivated land that is privately owned including moorland, heath, mountain".
A vast car park on a retail park is the urban equivalent.

Then you try and go in/phone when it's open! Not rocket science is it?

Why not take this discussion to a thread for it ? This is not helping the OP at all !

Nah, can't be bothered. Just trying to point out what I regard as reasonable from both sides. We don't know how often the OP parks there anyway. But if it was just a one off occasion, then I would concur in getting him off paying.

Should have asked - were there any signs around and, if so, did they specify any charges that could be levied for contraventions?

There were but stupidly they weren't read so the assumption was made that out of hours was OK. Parking eye are new additions to the car park which was also not known about...the signs stipulate that the car park is free for one and a half hours and are for customers use only...

Know people who park there all the time as they reside opposite - they advised using this particular car park....on speaking to them they advised to ignore the notice as they have with no come backs

We know - but that is OLD ADVICE. Parking Eye have changed their habits in recent months and now they have started to take ignorers to small claims court, MONTHS and even a year after going quiet. So we now have new advice and your local people won't know this. We know what we are doing so hang around and follow our advice.

Our current advice is to send a challenge as already advised. Stroma even gave you the wording to copy.

All you need to do is come back when you get your rejection letter and POPLA code - and DO NOT send the same short appeal at POPLA stage nor word it without help re the legal challenges to include then. When you send the short challenge to PE, spend the waiting time reading threads about POPLA appeals so you know what's in store.
