Neighbour smoking in his own home is affecting me......

    Many standard tenancy agreement state,for example:
    k) Not to smoke tobacco or any other substances in the property or allow others to smoke in the property
    o) Not to cause a nuisance, damage or annoyance to other neighbours adjoining the property or close by.
    or, relevantly:
    Not to use the Accommodation for any illegal or immoral purpose

    True, but the idea is to get a dialogue going. In my experience, if you make your problem a problem for the Council, they're inclined to help. Building Regs or not the Council won't want the possibility of a fried rate payer in its jurisdiction. :rotfl:
    I would be amazed.

    The council has neither the powers, manpower, right, or inclination to take action against the myriad of properties in their areas that were constructed at times before modern fire standards were either known of or required.

    I had this.

    Tell him that smoke is getting into your flat and ask him if he can see any obvious holes in his flat that can be blocked up. Tell him you'll work with him on that as its you that has the problem.

    He might be reasonable about the smoke then, otherwise you'll have to get some air purifiers and stick them near where the smoke it getting in.

    OK thanks. You don't want this to escalate into a dispute unless it really has to, as it then becomes disclosable should you wish to sell your home.

    I would follow ruggedtoast's line of thinking. I'd actually go and talk to them. Tell them what the situation is, and see if there are any practical things you can do from either side to block the smells. If you work together then you might be able to identify where they come through. It's not like you are one flat above another, being side-to-side there are probably only a few gaps in the walls.

    If you were to indulge in a white lie, you might claim that one of your friends/relatives is in the police and whilst it's no concern of yours what people do in their own homes, you'd rather not have the smell come through when they are visiting, for their sake. This might encourage them to smoke in a different part of the house.

    Maybe they are smoking more while they do their DIY, most people do. Also is the place unfurnished at the moment? Fabric etc does absorb smoke.

    If all else fails, tell him you nephew is a Policeman who visits regularly and you'd hate for him to get in trouble due to the strange smells..:p

    Talk to the neighbours on the other side of the spliff smoking new HA tenant and ask if they're having the same problem.

    Personally, IYSKYDIVE (but that is no affair of my neighbours).

    What you need is some other legal issue that can be used. Are the tenants breaching any terms in their lease that you know of?
    If there are legal issues to be resolved, best ask someone qualified. I would try to help but IANAL ! :D
  • Surely even if they give up the illegal smoking you would still smell the legal smoking?

    Not much to be done I'm afraid. It is perfectly legal to smoke in your own home.

    I had this problem in my old house (cheap Victorian terrace).

    Solution: lift up your carpets and use duct tape (from Poundland) and cover all gaps between floorboards. While the carpet is up get a jumbo tube of translucent bathroom sealant (also from Poundland) and squirt under skirting boards. Start with the living room and then the next most affected room.

    Will also reduce your heating bills
