    Just received the UKPC final reminder after 15 days of first notice to keeper letter. This reminder no longer says Notice to keeper..

    I am going to reply to the first letter shortly with my soft appeal.

    Any further advice from anyone?

    That in itself is a breach of the code of practice. They are supposed to wait 28 days for you to respond to the first notice.

    Get your soft appeal in. You might also add that you are keeping a record of all their breaches of the BPA Code of Practice, and when you are satisfied that they are finished getting things wrong you will be reporting them to DVLA and BPA for Code of Practice breaches, and to Trading Standards for possible offences under the Consumer Protection from Unfair Trading Regulations 2008 (failure to comply with a code of conduct to which they have committed).

    Hi all, I received a parking charge on Saturday. My own fault really. I parked in a retail park and was in the shop literally 15 minutes. (sure they were watching) I completely forgot to get a ticket. The ticket is for £100 or £60 if paid within 28 days. The car park is free for the first 2 hours, but I received the charge due to not displaying a valid ticket. Is this enforcable in Scotland? I asked in the shop but they said it had nothing to do with them.

    Any help appreciated.:(

    Why the long face, jeez this is NOT your fault and it's a scam! Not enforceable in Scotland unless you tell them who was driving and they then decide to sue that person (unheard of in Scotland)...but they'd only know who was driving (name/address) if a person is daft enough to 'appeal' for instance!

    Please just ignore it and the letters that follow, as you are in Scotland and normally I would say start your own thread - but you don't need to as long as you don't reply here (this thread is completely different and not in Scotland!). This is Flyazure's thread and must be an England/Wales case as he/she is reading up on POPLA which doesn't apply in Scotland.

    Well, here we go again. This criminal parking company just don't give up.

    My soft appeal was sent on 11th July and I received another letter today the 31st July. It says

    " Thank you for your recent correspondence in relation to the above parking charge.

    We have investigated the appeal based on the information submitted by yourself and can confirm in this instance that the parking charge has been correctly issued.

    However in order for your appeal to be investigated further, please could you provide the name and address of the person who was driving the vehicle at th time of the offence. Unfortunately we are unable to answer any of your points raised in your appeal until we receive these details.

    The parking charge has been on hold whilst on appeal and may be settled in full at the reduced rate of £45 provided payment is received at the below address within 35 days of the date of this letter (26th July).

    Signed but illegible and not underwritten in print..

    I thought they had to issue a POPLA code?

    Please go on to the POPLA web site, "Contact Us" section and inform them of this PPC's refusal to give you a POPLA code.

    Copy the essence of your appeal to the PPC and their reply to you and ask POPLA

    (a) Is the PPC correct? (see *** below)
    (b) if not, will they instruct them to issue the code.

    In addition, send a copy to the PPC telling them you will be awaiting the POPLA reply, but referring the PPC to the quote below.

    This needs clearing up as these PPCs are now deciding what they accept as an appeal.

    Who can appeal to POPLA?


    Anyone can appeal such a parking charge notice providing they follow the process below. If you want someone to appeal on your behalf, such as a family member or friend, they can do so but there can only be one appeal for any one parking charge notice.

    Provided you made representations to the operator who issued the parking charge notice and these were rejected, you have 28 days to appeal against the operator’s decision. If you do appeal to POPLA, which is independent of both the operator and the BPA, an impartial Assessor will consider your case.
