Hi all, the ticket stuck to my bike was on 4th May 13, and the notice to keeper arrived by unsigned post today 19th June (dated 17th June).
Best advice please? Should I ignore as advised earlier or reply with objections?
- no signs at entrance or anywhere near the disabled bay I was close to.
- no mention of the duration of parking, only on either the ticket or letter. On the ticket it only shows the time issued and the time first seen, which are the exact same minute. I was only in the store for a couple of minutes!
- the letter states my bike details and that it is a different make than it is!

Do a soft challenge as you'll find posted on lots of threads today and yesterday, have a look. In your case I would add in that you have subsequently been there to check the signs (not 'been back' as that would be saying who was driving).
Include this bit that you said earlier (but without the info as to the driver so word it carefully!!), in the soft appeal, I would add:
''I just went to this car park to specifically look for any signs that you have there. To my amazement I could find nothing until I drove around the one way system to the exit, where I finally located two identical, quite small signs. It is possible to exit mid-point in this car park, without entering the one-way system section, [STRIKE]as I did on leaving with my motorcyle, [/STRIKE]and entirley miss the Exit signage. They are attached, high up a pole to both sides of the exit road, on which the Exit sign is displayed and on the reverse, the No entry sign shows to the rear.
As such the signage is non-compliant with the BPA Code of Practice.''
This is to add to the usual soft appeal from the registered keeper (you) to that letter (not mentioning the PCN nor the driver, nor 'what happened').PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It sounds like they haven't complied. That should go in your appeal to POPLA or you could put their failings, with a couple of photos, in your appeal to them, but still saying either accept my appeal based on your failings or send me the POPLA code.0 -

Also, from your earlier post, should I add [Also ask them in a separate paragraph, to clarify whether their 'charge' is issued under tort of trespass, or contract, or breach of contract, and to clarify whether any loss has been made and by whom. If the loss was allegedly suffered by the landowner/retail occupier, then how does UKPC pass this on to them and how is this loss broken down? {There are reasons for asking this!}.

A 'PCN' in the case of a private fake one is 'Parking Charge Notice'.
They use that acronym to impersonate a real Council PCN = 'Penalty Charge Notice'.
And yes, you can add in the bits you have quoted, all relevant.
But honestly, this first appeal is nothing to worry about and can even be a source of amusement, see the links I just posted here:

It is really only the POPLA (second appeal) stage where you need to work on the wording, this one doesn't matter as much as you'll get a rejection like the Parking Prankster did in his cases in that link. You've had the notice to keeper so to save you time here is a soft appeal you can use , either email it or send with proof of postage from the post office

Dear Scammers,
In regards to the invoice received with ref number xxxxxx dated xxxxxx, the keeper denies all liability to your company, if you reject this challenge the keeper requires within 35 days a popla verification code for them to appeal independently, per Version 3 of the BPA Code of Practice.
The keeper has nothing further to add, and will not respond to any correspondence from your company unless it contains the popla code. If you wish to find out why the keeper rejects all liability, pay the £27 plus vat to popla to find out
The challenge will be deemed accepted if there is no popla code on any rejection that you supply within the time-frame stipulated above.

I would do that sort of soft appeal but add the part about the signs in post #13.
I do feel there should be something said in any soft appeal as to what the challenge is about (even if just 'your signs are not compliant' or 'your charge is a penalty and therefore unenforceable').
You could also finish by saying, in all honesty, what you said to us 'I could really do without this extra stress as I am caring for my father in law who is terminally ill with cancer' and we'll see if PE cancel or not...just don't add any sentence by mistake that implies who was driving.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
