Just a note to keep anyone else owed money by Your Building Maintenance Ltd up to date.
It appears the company who were employed to chase debts on behalf of YBMltd have decided not to carry on working on their behalf as they haven't been paid. Also, speaking to firms who Wayne claims owe him money it seems that all the problems with cash flow are their own making due to poor invoice communication and bad business practise on YBM ltd's part. Surprise surprise!
Been told that the firm have no money whatsoever as the bank are owed lots by the amateurs and are getting their cut back before paying anyone else off.
I'm still hearing claims by Wayne that he wants to make sure everyone gets their money as he feels responsible! Pmsl YOU ARE responsible!
I think a good idea for people like Wayne is to make them display a big red L sign like learners do so we aren't taken for mugs by liars who don't seem to realise telling porkies winds people up!0 -

I have had dealings with robin and wayne from this sham of a company. There buisness model is to flood an engineer with work for 30 days untill it comes to invoices being paid and them fob them off with every excuse under the sun with reasons not to pay.
I have invoices from december outstanding from these clowns. Avoid.avoid...avoid.
I have sent numerous emails to them, many calls and recorded letters, on one call the new guy forgot to push the mute button and i heard all sorts of f's and p's regarding how people are not being paid.
I am also in the process of contacting gas safe register, oftec, niceic, and of course watchdog, i would sugest that anyone else who has had a problem with "your building maintanence" or (scamming *&^%$) to do the same, as the more of us that do the more likeklythey are to be publicy named and shamed.
In short a very bad scamming company that defrauds work out of hard working engineers and i intend to make it very hard for them to get new engineers to scam or contracts with new letting agents....... """"""""""""""""""""lets all help each other""""""""""""""""""""
p.s. Anyone defending these scam artists is an employee or relative as any one else is owed money by these ^%^%£%£$.0 -
unclebulgaria ive noticed you are at court in september with wayne, I dont suppose you could let me have the date as this would be a perfect time to serve any papers I have by then, as my legal process is underway (wayne/robin may have thir own parking space there by christmas)

The company will be shut down in due course and you'll be even worse off.
You can apply to the courts for the company to be wound up (it's quite pricey though) and the receiver or IP will bring any wrong doing to light and has the power to pursue the directors.0 -

You may be right but if thast £25 spent gives them just a taster of the hasstle ive had trying to get money owed to me from them then I will sleep a bit better at night. "Its better to try and fail than not to try at all"0 -
For those owed more than £750 you pay £1,385 to petition for the company to be wound up. You have to issue a statutory demand first.
When assets are being realised these costs are prioritised, even before further fees by the IS. If there is any assets that is.
The receiver will go through the companies affairs, to for example check for illegal dividends and convert any to a directors loan account. The DL is then an asset of the company and needs to be repaid. They will look at the affairs to determine whether the director(s) have breached their obligations under the Companies Act 2006.
Because of the Ltd status (ie the Ltd being a separate legal entity) you have few options in chasing the directors personally, but the receiver can apply to the courts for a restriction order banning the directors from running companies for x years if there has been gross wrong doing.
There has however been a case in the (not so distant) past whereby a company director was successfully sued after several failed promises to pay the money - despite reasonably knowing the company was insolvent. Although if memory serves correctly this case wasn't defended, so if it was then I suspect it could be easy to overturn.

Of course this doesn't guarantee you will get your money back, in fact far from. It also doesn't guarantee and restrictions placed against the directors, as it would depend how the books look. It would also depend what assets they have - and remember, if assets have been historically sold to a third party for below market value in an attempt to evade such action, the receiver has the power to reverse the transaction. Sorry, but in this instance I wholly disagree. If he was a sole trader I would agree based on the fact he would personally struggle to obtain credit in the future. But it's against a company so has no affect on his personal credit status. He clearly knows the system, hence ignoring other creditors of his and having a list of outstanding judgements already - I doubt another one would affect them.
Sometimes in business you just have to know when to cut your loses. Rather than cutting off your nose to spite your face.0 -
Normally I would agree with you arcon but I've been told that the more people chase this company the more chance that the receiver will find against the directors in the event of a winding up order. Its £25.00 at the end of the day and it can be written off against your tax bill.
Wayne is apparently now working from home as he's telling people that the office is no longer used. Caroline has had to find a job to make ends meet (shame eh?).
I will give anyone thats interested all the information they need to pursue these toerags.

Please keep posting, I have not once ounce of sympathy for Wayne, Robin, Caroline etc with regard to their personal circumstances as they have not been honest with anyone as far as I know.0
