Court success thread

I suggest not counting any victories or losses not reported directly on this forum - because then it becomes distorted. I have no doubt that many folk are winning and losing cases, and they never visit this site and make much public impact. But we have a neat control group here, which should give us an accurate feeling of the chances of success once you press the big red button called "Court".
So far I would advise - with the caution you'd expect from a bureaucrat - that the balance of probability favours the robust and expeditious initiation of litigation.;)

Im just starting my journey and this is all very helpful, thanks to those that have posted :T0 -
Though it is a slightly confusing post, with some confusing circumstances, this seems to constitute another court success?

Are they settling the cases but not accepting any liability so you can't use someone else's successful compensation claim for the same reason as evidence in Your action?0

Hmm about s clear as mud old chap.
I am not sure about that quote from longhair very contradictory says he has only just sent allocation questionaire court awarded him his money and they settled out of court and he wrote telling them not to send which he has received all in about the space of about cant make head nor tail of it
just found his first enquiry june 11th Hi all
So I took a flight with Thomson May 2007, which was delayed or cancelled, I couldn’t remember – I was either put on a later plane from the same airport, or sent to Bristol in a taxi with some other people. There were two separate occurrences, and this flight was the only one of two I took from the airport in question looking at my emails…I used to travel a lot.
I went through Thomson to make my claim, was told they’d get back in touch in 56 days, a month after this deadline, I heard nothing, so I was forced to file a claim before the 6 year deadline was up.
Now they’re claiming the plane was 10 minutes delayed, which must mean I was denied boarding because the flight was full, right? I defo didn’t do anything wrong, and I remember something about this denied boarding. It WAS six years ago.
There is no info on flightstats. Further, I have asked Thomson to verify for themselves from the passenger manifest that I was not on the plane, and whatever records they have to show when they send passengers to a different airline/airport. The one thing I am certain of, and I would not have begun a case through MCOL otherwise, was that the delay was about half a damn day to get where I was going. So I am definitely entitled to my 250 Euro.
Thomson now saying the onus is on me to prove I was not on the flight/was denied boarding. The whole thing seems suspicious to me…no flightstats, not responding to my request to investigate (thinking I would go beyond the 6 year limit I reckon), etc…
So I filled my allocation questionnaire yesterday…
Thoughts, you cool mofos?0 -

My successful claim should give you a good indication that Virgin will settle with you too. As I said in my PM, you can try asking Virgin again using my case as a reason why they should settle out of court, but if you start court action I can almost guarantee that they won't let it actually get to court.0 -

No indeed. And all for a flight in May 2007, for which he would be out of time anyway. Very odd.0
