    Are they settling the cases but not accepting any liability so you can't use someone else's successful compensation claim for the same reason as evidence in Your action?

    So I took a flight with Thomson May 2007, which was delayed or cancelled, I couldn’t remember – I was either put on a later plane from the same airport, or sent to Bristol in a taxi with some other people. There were two separate occurrences, and this flight was the only one of two I took from the airport in question looking at my emails…I used to travel a lot.

    I went through Thomson to make my claim, was told they’d get back in touch in 56 days, a month after this deadline, I heard nothing, so I was forced to file a claim before the 6 year deadline was up.

    Now they’re claiming the plane was 10 minutes delayed, which must mean I was denied boarding because the flight was full, right? I defo didn’t do anything wrong, and I remember something about this denied boarding. It WAS six years ago.

    There is no info on flightstats. Further, I have asked Thomson to verify for themselves from the passenger manifest that I was not on the plane, and whatever records they have to show when they send passengers to a different airline/airport. The one thing I am certain of, and I would not have begun a case through MCOL otherwise, was that the delay was about half a damn day to get where I was going. So I am definitely entitled to my 250 Euro.

    Thomson now saying the onus is on me to prove I was not on the flight/was denied boarding. The whole thing seems suspicious to me…no flightstats, not responding to my request to investigate (thinking I would go beyond the 6 year limit I reckon), etc…

    So I filled my allocation questionnaire yesterday…

    Thoughts, you cool mofos?

    My successful claim should give you a good indication that Virgin will settle with you too. As I said in my PM, you can try asking Virgin again using my case as a reason why they should settle out of court, but if you start court action I can almost guarantee that they won't let it actually get to court.

    No indeed. And all for a flight in May 2007, for which he would be out of time anyway. Very odd.
