In that case, they haven't got a leg to stand on, providing the judge is au fait with Folkerts....... make sure he/she is!!0

That's the thing I am using small claims in Scotland when I went to the court not one person had a clue they hadn't come across anyone using the small claims to do this before. If it wasn't for stavros guiding me and me telling them what to say to them they weren't going to accept my claim. They told me at first I had to use an English court. So I am hoping the Judge has read up on the Folkerts case.

Yes I had thought about doing that was just waiting to see what happened. Did you see my earlier post it looks like United are going to settle out of court.
We are in receipt of the lawsuit you filed in the ****** Sheriff Court regarding the 2 hour and 33 minute delay of your flight from Edinburg in 2010. Our records indicate that we have explained our position several times, which remains unchanged. In the interest of settling this case, I would like to offer each member of your family a $1,000 electronic travel certificate valid for one year from the date of issue toward a ticket on United Airlines. Please let me know if we can settle this matter out of Court.
I have emailed them back declining the offer.

IMO this forum could do with a few more experienced Scots posters who've gone through the process north of the border, - clearly it's a different way of doing things.
Whilst I'm writing, can anyone confirm that the Scots time claim limit is indeed 5 years, as opposed to 6 years in England & Wales?

Yes you are right 5 years in Scotland. I will be staying to advice anyone and Stavros helped me he said he was staying as well.
I think our court process is a lot different, I took my papers to court on the Tuesday by the Friday I had a letter to say the summons had be give to United and they had to return the summons by the 8 July and a hearing date had been set for the 22nd July at 10am. So it seems a lot different from the MCOL that can be used in England and Wales.
