    HI everyone,

    Got this email from United.

Ok, thank you. I will put it through like that. My system will not validate it for some reason. I will authorize payment today. It will be processed by our London finance office within 14 days.

If they leave it for 14 days it will take them over the Return date for the summons. Should I insist that they pay before the 8th July. I have said I am not informing the court until the money has cleared in My account.

    I wouldn't wait that long.
We agreed asettlement figure on a Tuesday and insisted they pay it into our bank ny the following Friday or we will see you in court. It was here on the Wednesday

    Hi Romanby,

Yes I have just read your post where you say that. Even if they are authorizing payment from the USA today surely it wouldn't take 14 days if their London office is dealing with it. A cheque would be quicker than a direct payment I thought that was the whole point no waiting for cheque's to clear.

I don't know about money transfers from abroad, but if you have been dealing with their London Office I would think they must have some financial delegation from their U S head office.
I would push them into a corner, they have admitted your claim, if it goes to court you can claim all the court expenses.

    Hi Romanby,

That's just it thought it is not coming from abroad now its coming from their London office. The lady at United could't process the payment because of the IBAN number. All she has to do now is email the London office and authorize the payment. No way can that take 14 days. Anyway I have just fired of an email telling her I insist this must be paid on or before the 8th July or I will be continuing with the court process.

Can anyone tell me success for cases that actually go to court. I.e not settled after being lodged with small claims but going all the way as it were. I have mediation booked for Friday and want to know what my chances are if I don't take an offer. I haven't asked for interest so can't use that to compromise. I have looked and can't see any where virgin haven't settled by now!

I am sure Virgin and all the other airlines are looking in on this open forum (wave everyone!!!) so if they can identify you from your posts, do just be a bit cute about what you give away about how you are going to negotiate.

Their cases may be weak, but they are not fools. Far from it.

I agree. If I were a virgin lawyer, I'd have Debsyh identified by now - and his/her apparent desperation to settle out of court ... If you want to face down the airlines before it goes to court, you have to say - and be prepared - that you'll take it all the way.

You might think about deleting your post, Debsyh.

    Hi everyone,

Money was paid into my bank account today. Just shows what a wee threat that court proceedings will be continuing if it wasn't paid on before the return date on the summons.

    First letter sent 3rd April,
    NBA sent 4th May.
    Court proceedings started 30th May.
    Paid out 5th July.

All in all about 14 and half weeks from start to finish.

Good luck to anyone else who has started court proceedings.

A huge thank you to all the people who helped me along the way. :T

    Hi Stavros,

Thanks I intend to enjoy every penny of it going to Loch Lomond for a weekend in August and a week to Benidorm with my son in September.
