    HELP....!! I have my small claims summons to hand into my local sheriff court tomorrow. I've just noticed the time limit in Scotland is 5 years. The flight I'm claiming for was on July 5 2008. Please tell me I am not too late, I thought the limit was 6 years??
    I have got correspondence with monarch dating back to April so am I within my 5 years or is it from when actual court proceedings start???

    I think you are out of time by 5 days. How unlucky is that? The deadline is from when the first court papers are served - correspondence with the airline doesn't count.

    Where was your flight from and to?

    If either the departure or arrival airport is in England then you can issue out of the English Courts, where the limitation period is of course 6 years.

    Thank you sooooo much centipede100 and cobyBenson! I could've cried last night when I realised Scotland is only 5 years:-( as the claim works out at 5400 euros. im in dumfries so only 30 miles from the border.
    Any advice on my next step now? As I'm not clued up on the English system. Again, thank you so much for your help and advice! X

    Put all the detail on the dedicated Monarch thread, delay, flight numbers etc and help will come your way. Just make sure you read the FAQ's on page one otherwise if you start asking questions already asked someone will 'advise' you accordingly!

    ouch, thats a really nice judge, love it. lets hope LBD can show us all the court claim and their arguments, it would help others to understand the process.

    Excellent result.
    Just shows if you show then you are serious they are going to have to fold as their defences are rubbish.
