Received cheque from Virgin this morning for £2120!

    Timeline:

01/02/13 Claim form sent to Virgin
08/02/13 Claim rejected - Extraordinary Circumstances
14/02/13 Further letter to Virgin rejecting their interpretation of EC
    03/04/13 Claim again rejected
    11/04/13 NBA issued
24/05/13 Claim issued through small claims MCOL
04/06/13 Virgin acknowledge with notice of intention to defend
    13/06/13 Cheque received with letter

I am happy with the outcome having paid c£10k for 4 upper class tickets and having lost a whole day of our holiday. Its a shame I had to take them to court to get them to settle.

Well, often Barristers will give you a price, it's sort of like piece work to them.

I don't think they charge for asking :D

If the cost of an appeal could be funded by a whip round amongst regulars, I would contribute ;)

Are my eyes deceiving me, or is the tally of victories to defeats now 21 to 1?

There was someone on the T C Get (dis)satisfaction forum who had lost their case - can't find the link now, sorry.

1 Lost - but moral victory, duff judge and cost Jet2 thousands, when they could have given me £450 6 months ago....

Why don't you appeal againsyt the decision, I belive you have 14 days to do so, making representation as to why the DJ's decision is incorrect.

I suggest not counting any victories or losses not reported directly on this forum - because then it becomes distorted. I have no doubt that many folk are winning and losing cases, and they never visit this site and make much public impact. But we have a neat control group here, which should give us an accurate feeling of the chances of success once you press the big red button called "Court".

So far I would advise - with the caution you'd expect from a bureaucrat - that the balance of probability favours the robust and expeditious initiation of litigation.;)
