    So this is a BPA AOS member then, so it means your options are to ignore or appeal. If you are asking what POPLA is, then the first thing to do is read the 2 sticky threads about POPLA at the top of the forum. That's what sticky info threads are there for after all, permanently stuck at the top of the parking forum.

    Either ignore it and all the Roxburghe/Graham White hysterical but toothless letters that will follow (also shown on another sticky thread of course) or wait for the first letter - Notice to Keeper - then appeal it to the company then to the second stage, POPLA (read the sticky threads about POPLA).

    Do not appeal YET even though the rubbishy ticket probably says you 'should'.

    Whatever you do, wait for them to write to you first, maybe they won't (I had a fake PCN like that!). If they do send a Notice to Keeper, keep the envelope if it's got a different posting date on it than the letter inside, and see also if they have met the requirements for registered keeper liability at that point:

    Then if they reject, check other stuff as I just mentioned in post #7 of this thread and include LOADS of demands and grounds of appeal in a POPLA submission (which costs the PPC money and is only binding on them, not you).

    So wait for the NTK and tell us whether you've decided to be an ignorer or an appellant. DO NOT get twitchy and think you should appeal now.

    Hi again, my ten days are nearly up for the reduced fine and i think im just going to ignore the notice but before i do i have a photo of the sign at the park entrance i would like to upload and have inspected to see if there will be any implications in doing so but dont know how to upload.

    I cant upload a pic of the sign so i have copied it out word for word. Some of the writing is bigger than other and there is evidence of amended parts as stickers have been stuck over it. Have a read and see what you think

    THIS LAND IS PRIVATE OWNED PROPERTY, VEHICLES PARKED ON THESE PREMISES ARE ENTIRELY AT THE OWNERS RISK.

    The proprietors accept no liability for any damage to such vehicles, theft from the same, breakins or accident of whatever nature, however caused, save that any statutory duties or obligations imposed by law are not affected by this notice

    All items, personal belongings, goods and or property in or upon such vehicles are entirely at the owners risk.

    You must display in the front windscreen of your vehicle 24hours per day 7 days per week.

    A valid ticket from the pay machine, a valid permit.No concession blue badge holder must pay and display, motorbikes must pay.

    unauthorised or failure to comply with this contractual agreement will result in the vehicle being issued with a parking charge notice of 80 if paid within 28 days (reduced to 40 if paid within 10 days)

    There is an additional charge of 2.5% for credit card paymerns.

    Parking shall be for no longer than the period for which the payment is valid

    All vehicles must be parked wholly within the markings of a bay or space

    This forms a contractual agreement, registered details may be requested from the dvla

    Please note that in adverse weather conditions the floor surface may become slippery. please therefore take care.

    Non payment of a parking charge after 28 days will result in an administration collection fee of 40 followed by you being liable for any additional legal, collection or court costs.

    This thread is about the same bunch - with a link to a picture of their sign - and I just posted a reply to that person as well:

    Same advice applies to you both really, so why not compare notes on what breaches of the BPA CoP you can spot and what other appeal points you can identify as your first challenge. Stuff about the confusing company name can be linked to an allegation that the NTK fails to clearly state who the creditor is (see links on the other Cumbrian poster's thread, to a pepipoo thread or two where this aspect is explained).

    Doesn't matter too much what you say at this stage - but obviously no admissions of error and no saying who was driving or giving info or excuses - this should not be a 'sorry' appeal, more of a 'complaint' challenge to the very legality of their rubbish 'charge'.

    You'll need more advice as/when you get a POPLA code.

    Hi every one, ive recieved my notice to keeper today, 5 days out of date so i have less time to decide on what to do, if i choose to ignore it what are the implications for the registered keeper if it goes to court, will i have the same chance to defend myself later on if i need to or will the keeper have to go along with it from now on if i ignore, i dont want to cause the keeper any hassle, if it does go to court i think i have a good defence for things i believe have been breached so far so what is best to do from now on in other peoples experience.

    They are out of date with the NtK, I make it 59 days since the 27/04/13 when you got this invoice. Which means it doesn't comply with the Protection of Freedoms Act 2012. Make dure of the date of letter and date of envelope. providing it tallys, you could write back and say

    Date


    Dear Parking Company


    Thank you for the Notice to Keeper for the invoice xxxxx dated xxxxx , as its 59 days since the invoice was issued, your NtK breaches the Protection of Freedoms Act 2012.

    So the matter is closed! If you wish to pursue this further send a popla verification code so it can be appealed there, failure of pofa 2012 will be an immediate win for the keeper there.

    The date on the notice to keeper is the 21/06/13 but it only arrived today, it says on the notice they will assume it was delivered within 2 days unless i can prove it and the post mark on the envelope was the 24/06 in london so this must be the date i have to work off as its obvious it hadnt been posted before it.
    What is the maximum number of days i must recieve the notice in

    You must receive it within 56 days otherwise it fails. The envelope is important here as obviously it was posted late. Keep the NtK and envelope safe as together it proves they have timed themselves out. It's their problem not yours that it did get to you on day 59 after the incident.
