So all road tax and insurance included in the lease cost, normally her car would be well under mileage at around 6,000 for the 11 months. The lease cost for the car was set based on it being returned under 12,000. The service is due at 12 months or 12,500 which ever comes first. The service would not have cost as included in the scheme, previously not had to worry.
If I’d known the mileage I would have realised it was due and sorted it. So yes I should have asked the question but yes she knew the mileage was higher than normal so should have made me aware. It doesn’t matter now as it’s too late and there is a cost to pay.
Notice the wording of her email is coming across very differently, clearly been advised.
In future it’ll be tied up in the wording of the financial settlement. For now I will wait for my solicitors advise. One option open to me is to stick to my proposal.
The thing is there’s a cost to pay and mine is still the only income so why should I have to absorb it all, something has to give. I don’t think I can get any more 0% credit cards to manage the shortfall I’ve got 4 now and with legal costs at around £1000 a month they’ll soon be at their limit.Regards

It may be best to avoid e-mailing or texting her anything without taking legal advice, given how crafty she/her lawyer are.
I suggest that you get written into the interim award agreement her responsibilities for looking after the car and the penalities hse has to pay if she does not meet them.
And one further thought, given how well she is playing this game.
Since junior now lives with his grandparents, they could claim CSA directly from you.
If you are unlucky madam could get an interim order and then GPs claim CSA for junior. She will claim that only the direct costs listed against "son" are deductable from the interim award expenditure listing and has you by the short and curlies to the tune of an extra £500ish a month.
So your lawyer needs to ensure that if any claim for CSA is made, the interim award is reduced by the same amount, from the date of contact not award.

I was trying to avoid writing but my solictor has been away this week and hadn't replied to my email last week. In some way not a bad thing to build up her replies to a minimum as each email I send her cost me £25 for her to read and about the same for a reply. I usually build up alll my questions into one email and try to minimise the number... Anyway thing is I'm due to pay voluntary maintenance tomorrow so wanted to know by then. i'll have to hold off untill i get her advise.?? The other points you've made I have previously mentioned to my solicitor, currently they are preparing questionaire in relation toher Form E and I'll be receiving one on mine asking to justify and prove etc.Regards

Sorry to hear Jack that your ex is causing you more financial worries.
I cannot offer you any advice on that matter as I am not knowledgeable enough.
I hope your solicitor can get you the financial deal you deserve.

Jack , I been following this thread for a while , I am impartial as a guy I used to see had a very similar situation , and everything what jack written here looks like coming from a person with good brains and admirable honesty and integrity. I do not see how this temporary hick ups could destroy one like that. Rhe only way she could get close to it is through children , hope it will not happen

Even if jack is completely broke he is not going to stop being who he is , for destroying that one would have to be placed in a concentration camp and even there some people managed to stay who they were.The word "dilemma" comes from Greek where "di" means two and "lemma" means premise. Refers usually to difficult choice between two undesirable options.
Often people seem to use this word mistakenly where "quandary" would fit better.0 -

I think I would argue that you were not expecting, nor were you aware of the fact that she had gone over the nominal mileage. As such, the responsibility for the service is entirely hers.
Also, you pay for the scheme... which includes one regular service. This service was above and beyond the scheme. She's responsible.Mortgage when started: £330,995

Sure , I understand and agree . Just wanted use it as an opportunity to point out that ending worse off than one could have done is a far cry from destroyed. It just seems to me that this person is really anger and wants to take it out on JackRS and hurt him as much as possible.
I am a cynical beast, having grown up amongst the debris of my parents' failed marriage which ended after 10 years incessant warfare. One I would not trust as far as I could throw them and they played all sorts of mean tricks. The other struggled to maintain their equilibrum, partly because of their own issues but also because they never knew what the next ploy was going to be.
It was only when the first screwed up badly in a sworn statement that we were able to put a halt to it all.
So I have seen all sorts of antics first hand.
I am not wanting to project onto JackRS but I am accustomed to looking for the chinks in my armour if you understand what I mean.If you've have not made a mistake, you've made nothing0 -

Having said that its more likely she does not have money so she goes after it where she sees it , ie in jacks pocket.
