    It does sound as if she's trying to manipulate the situation but, if you weren't there and she wasn't well enough to work, what would she do - claim ESA, like thorsoak says.

    The doctors visit is exactly what I thought might happen, further up this thread, seems to be the tactic of choice now, it doesn't just get her out of work it also puts her in the role of victim, everyone now sympathising, how awful, and no brownie points for trying to be strong and remain calm.
    This must be the easiest trick in the book to pull off because stress of break ups are well documented and understood, at least you've been forewarned, you can prepare for this.

    Has has actually shot herself in the foot here?

    First implying she is too ill to work, but then saying she is going for interviews?

    Spousal maintenance counts as income for means tested benefits. If you are paying her £1000 per month she will not be eligible for Income based JSA which is 71.70 per week. Although she will get her NI stamp paid. I don't know how it works with ESA though.

    Child maintenance is not counted towards income.

    A judge would still expect her to claim the benefits she is entitled to and she isn't prepared to do this. It will be her that loses out in the long run, I can certainly see why you no longer wanted to be in the marriage the woman seems to be manipulative and awkward, the kind of person to chop off her nose to spite her face.

    What he is paying atm also includes child maintenance for 2 children, it could be argued it is purely child maintenance over and above the CSA guild lines and would therefore not be counted.
