Agreed - My understanding is Jack is paying just CS now anyway (even though her entitlement to CS before she moved into her parent's home (where son had already lived for months) was a bit of a grey area anyway-and something I'd have expected a rottweiler lawyer to use. SM isn't currently paid so nothing currently to review with that.
I'd like to see it mentioned somewhere that Jack continued to pay CS even when the child was no longer resident but staying with another family member supposedly temporally but was a period of X months in reality and was permanent enough that he enrolled and attended college there some 150 miles from where his mother lived. I think it may give a judge some insight into the fact she was collecting child support (and child benefit)for a child she wasn't housing or supporting herself but had passed that responsibility to grandparents. It may help illustrate her attitude of expecting everyone else to carry her financially -and show she had no excuse to not actively seek employment in that extended period. There's also an unspoken implication that she was claiming child benefit when perhaps she wasn't entitled to- which wouldn't hurt Jack's case.
It was always my feeling that legally once son had moved into grandparents and enrolled in college (showing intention that it wasn't a short visit but he was living there) she wasn't entitled to child support or child benefit as he was no longer resident with her . If he had gone away to college and was lodging it would be different but with no rent paid he had moved into the care of his grandparents (and got the short end of the stick as he had to move away and she didn't follow him shortly as promised although I suspect blame for that was heaped on Jack although she could have moved in with her parents at any time and left Jack to sell the house)I Would Rather Climb A Mountain Than Crawl Into A Hole

Jack I am so unbelievably angry with this woman. She has a job now and lives FOC with her parents and wants all your money? I'd slap her if I saw her. Then give her a kick for good measure.
I'm not up with all the legal stuff, but what would happen if you stopped giving her any money at all? As in, make your final CM payment in May and stopped paying for the car?

Our client notes that the current lease agreement for the car is ending soon and the car will be returned. As circumstances have changed in terms of location and residence now the marital home is sold this is one of the issues that needs resolution and agreement as there are differing proposals from our client and xMrsJ . As these will form part of the final settlement this makes early agreement desirable in ensuring any new lease contracts or commitments are not postponed as they inevitably will be if final agreement of full settlement is delayed.
(It's a bit wordy -and I'm not 100% happy with it - but I think it covers it without suggesting maintenance is a given but just a possibility -and makes it clear if she doesn't pull her finger out she won't have a car for at least a while)
I think you need to be very careful that Child support doesn't morph into SM by continuing to pay it after the end of August -as a side note.
My fee is a large cappuccino and a squidgy cream cake btw

Thanks for your views and empathy. In terms of the car it's an agreement I have with my employer so the money is taken out of my salary. I can't just stop paying, the plan is to not order a new one and manage the return of the old. If in time it is included as part of settlement then I'd order from scratch which would take 3 months which wouldn't give her a problem as her mum and dad both have cars that she's insured for.
In terms of CSA if we ignore the issue of if he was eligible I believe I am required to pay £650/m to end of August.Regards

With reference to the complaint to Brethertons, would you like a copy of the one we sent? I also have some contact details that may prove useful if you'd like them as well? We ended up shaming them on Twitter but it worked and we finally got the decree absolute. It only took two years :eek:
