    Definitely stop paying her in the meantime (once son finishes college etc). I can't believe that woman! :mad:

    Jack you have done everything you can to be reasonable -Time to stand firm - engage your own advocate for court..........and make some enquiries about the possibility of making formal complaint about the behaviour of the court - No judge- informed court staff wanted it rushed through so they could leave early for Easter etc. I'd consider talking to my MP in your shoes about this aspect. Might help secure an earlier court date !! An MP taking an interest can change supposedly rigid timescales and delays with government departments in an amazing way sometimes ;)

    So what are you going to do about the car ?

    For the car I get notification when I need to order the replacement normally about 9 months after the previous one was delivered. I haven't got that yet, but if she doesn't agree I will not order a replacement. The problem will be getting the existing one back from her as it has to be taken to a specific place and any delays or damage or extra miles outside criteria I get charged out of my salary, obviously I would discount that from any future payments.

    I've just check current car was collected 1st August 2014 so change is due in July, I'll get order request any day now.

    Dear Mrs XJ

    As you are aware the company car you are currently in possession of is a lease car on an annual agreement. The current contract ends on the 1st August and this car needs to be returned to XXXX by midnight on 31/7 . As this would be a long journey for you I propose that I collect the car from you on (date weekend before) if you would prefer. Regardless the car needs to be returned by 31/7 so please advise me if you would like me to do this or prefer to make your own arrangements as beyond this date the car will not be legally available to you to drive and you have a legal obligation to have returned it to xx (car contract co or J's employer whichever is correct) by this date.

    (sent to be signed for so there is proof of delivery)


    No mention of a replacement car - as when she asks you that is when you inform her that as the car contract is a part of the - now stalled- settlement you are unable to arrange a new contract before this is agreed as part of the final settlement details.

    Yep that was my plan, thanks for drafting the letter would cost me many £ if solicitor did it!

    I wouldn't send it signed for, I would send 2 letters via first class proof of postage from 2 different post offices. It is the suggested postage route for any disputes with LL's & letting agents. A signed for can be disputed as a neighbor signed for it & I never got it blah blah but 1st class proof of postage from 2 PO's is considered the best & most provable route.
    I don't respond to stupid so that's why I am ignoring you.

    I’d like to confirm that you don’t includethe sentence in your draft letter ‘or come back to us with proposals that reflectyour client’s position at the FDR’

    My position is clear I made this proposalat FDR to avoid further legal costs of negotiating, it is reasonable and fairconsidering appropriate discount value for pensions. I am prepared to go to final hearing if thisis not agreed as I would be better off if the outcome is to share the capitalequally and order a pension share and maintenance, as the cash now has morevalue to me.

    I would also suggest you point out as MrT mentioned to me that if at the final hearing the settlement is similarto my final offer I have grounds to claim costs against her. Also if no agreement is in place the currentcar will be returned at the end of it’s lease period (July 2015) and noreplacement will be made and no voluntary spousal maintenance will bemade.

    She has 2 choices accept or go to finalhearing .

    In terms of discount value for the cash equivalentpension offsetting please also indicatea more appropriate value and point out that actuary was not recommending 10%but showed it as an example.

    look at gov site and it states the following:

    When approved education or training ends

    When your child leaves approved education or training payments will stop at the end of February, 31 May, 31 August or 30 November (whichever comes first).

    Not sure how to read that?
