Secondly, if the judge sees jack paying the higher amount of maintenance, he/she may see this is a benchmark, which Jack does NOT want.

Hmmm, that's true too. The problem is that even if Jack reduces the payments for the next few months leading up to the court case, he's been paying the higher amount for so long (and I assume the figure will be somewhere in the paper work provided to the court.) So if the judge is inclined to see it that way, then he/she will do so.
I really hope it doesn't go that way though. What she's asking for is completely unreasonable, particularly considering the ages of the children!0 -

So? All Jack's solicitor needs to say is, my client has been paying over the legal minimum for more than a year, to voluntarily, assist his (ex) wife while she makes realistic attempts to re build her work history and gain employment, which she hasn't been doing, but he can no longer afford to do this, so has reduced the maintenance accordingly. i.e. the truth!0 -
He's reduced it now that both children are off hand. perfectly reasonable action & one that can explained in court as such. He can also show support to both kids & can also show evidence of his son actually living with the grandparents so mother has all that money for nothing.I don't respond to stupid so that's why I am ignoring you.

Yes, I realise that. I was agreeing with the point you made and adding my own thoughts. No need to be so snippy.0 -

I think that if the judge has any heart, and I pray he/she does, that they will see how generous Jack has been, from the beginning, and still is.
Anyone can see the debt Jack has accrued and how his life and health have suffered both financially and mentally.0 -

Also, if Jack keeps paying he £1150 a month, or whatever it is. When they get to court, the judge will see that he can afford to pay this, where the reality it, he can't.
And if Jack's barrister is on the ball, he can state that in so doing, Jack has almost bankrupted himself and incurred debt of £xxxx which is easily evidenced. That it was a temporary measure to enable MrsJack to manage until she returned to work but is simply unsustainable long-term.0 -
