    Many good points made , bonfire. But :
    Jack is not going to live there to sell it , tenants will.
    If ex gets money from it then once it is sold she will want to keep getting that money , from jack.
    If she gets money from it she will mot want to sell it.
    The best thing jack could do to her is to cut all financial ties asap in my opinion.
    The word "dilemma" comes from Greek where "di" means two and "lemma" means premise. Refers usually to difficult choice between two undesirable options.
    Often people seem to use this word mistakenly where "quandary" would fit better.

    wow, really? sorry Quidsy if I offended all women everywhere...

    Justme11-- Tenants CAN live there and LL (JackRS) can still sell it. If a family wants to rent for 6 months and Jack decided to get a place somewhere else, he can still sell the house. in fact it will sell even better if tentative clients come to see the house for buying and they can see its full of toys and a lovely kitchen and a fantastic garden for kids etc. I would venture to say it will sell faster with tenants living in it than if it was empty.

    OR, Jack can live in one room and rent out the other 3 rooms to his mates...either way.

    When the case goes to court its not up to Mrs Jack if house gets sold or not...its up to the Judge. Whatever she wants regarding the house, is not really going to count before the judge..... what we know is she wants to move south.

    Thanks Bonfire, I had considered the option of moving back in and getting some lodgers, however she would expect me to pay her enough to rent . The problem with renting is also the set up costs and as it would need a new boiler really. However i does make sense if the only way to give her the encouragement to go south is if she has income from renting it out.

    We have today reduced the asking price to see if that creates more interest.

    Please go over to the Renting Selling and letting forum and learn about tenancy law.

    If JackRS lets tenants into the house for 6 months and gets everything (Gas Certificate, deposit and paperwork etc) absolutely right, it could take 6 months after the end of the fixed term to remove the tenants.

    And you will learn that buyers are advised to be careful about offering on tenanted properties; many will only do so if a correctly issued S21 notice has been given and they are the ones prepared to take a punt on the tenants moving out of their own voilition. So JackRs and ex would be reducing the number of potential buyers.

    As it is the fact that the house is a divorce property is already reducing the number of potential buyers. Once there is a clear settlement, it may be easier to sell.

    The court will rule on division of equity once the house is sold , it will not mandate for Mrs jack to sell it!
    Jack , I am not sure you want your ex all comphy down south while the house unsold . If fact I think the less comphortable she is with status quo the keener she will be to reach resolution and negotiate with

    --- if I had time, that might be fun! but, no thanks. Maybe we could give that to Mrs. JackRS to research, she seems to have time for all of us.

    Getting a Gas Certificate is not a big deal. I used to work at Taylors ... Each agency uses a contract that does this job for them. It costs a cost (as do all pieces of paper) and its done.

    and no... if you are a tenant you do not get the luxury of hanging around for 6 months AFTER your tenancy ends.

    Seriously, I don't really care if the house does rent while its waiting to be sold.... all I'm saying is that it would be nice if it doesn't take years and years to sell without bringing the Jack's anything. Yes Mrs. Jack has claim to it...either through sale or rent.

    ...and yes if you offer her some benefit from moving out of that house ... she will move south.

    You are incorrect.
    A tenant can stay in a property after the tenancy period ends & until such a time as the LL legally & correctly issues an evection notice & only after a court validates that notice & send officers round to evict. As long as the tenant keeps paying rent they have a lot of rights over the property.

    As I mentioned in my post... I am trying to bring up the fact that NOT ALL tenants are like this. I can see clearly that some people have had bad experiences with tenants, yes I understand. But there is the other side, the brighter side. There are loads of good stories of positive expediences. There are plenty of good people who will move when the contract has ended. Especially if the rent agreement is done through an agency. Many families might need a house just for a few months to be in a correct catchment for the school etc. etc. People rent homes for many many reasons. Obviously the tenants would need to be screened.

    Look, I don't know the answers I'm just saying that If I was looking to buy and I went for a viewing and the agent told me, "Here we have a lovely, functioning family home" and I can see that it is being used and it is a great place to live, I might consider buying it! but if the agent said, "Here we have a lovely family home, but no one is living in it, its been on sale for almost 3 years...." I would ask myself right away, "Well, why??Whats wrong with this house?" Why would I want it if no one else does?"

    I don't know the answers but I do know that it's not selling and its especially not going to sell if the Ex stays in it, and the Ex is not going to be able to move on either if she stays there. I do believe that for every bad renting story there is also a good one.
