Hi, am chasing HBOS too and that's a standard letter they're sending out at the moment to everyone, I'm told. On another thread that I can't quite find at the moment, there's advice saying that you can call the number on the top of the letter and ask for the case to be reviewed, or just write again a bit more strongly, maybe mentioning court or the ombudsman. I took the latter route and added this paragraph:
"You are also correct that I agreed to the terms and conditions when I opened my account; however as you may know, if the terms and conditions of a contract subject to UK law do not comply with said law, then such a contract becomes legally unenforceable and no agreements deriving from it can be binding. (Regulation 8(1) The Unfair Terms in Consumer Contract Regulations 1999)"

So this seems to be a standard frightening letter BoS are sending out is it.
So it's worth phoning the number at the top of the letter asking for the case to be reviewed or taking it further to the Ombudsman.
I think that all banks will be reviewing this site and planning stalling tactics accordingly, so it's worth us all sticking it out on this one.

HBOS insider hints. It tells you to phone and ask for case to be re-evaluated.

has anyone got or knows where i can get my hands on T&C's for the nationwide that date back to the mid 80's for my flex account? just started MCOL and so am starting to pull all info together.

I am trying to put together my court bundle just in case but need t&c for nationwide i opened my account with them in about 1999 .
Any help would be great.
I have copys of all letters set and received and copy of charges what else would i need.
Nationwide acknowledged claim on the 11th june so anyone know time frame from here for nationwide if they do defend what then how much longer from that stage .

Seeing as this site is working in conjunction with CAG (Consumer Action Group), would it be an idea to ask if Martin Lewis can mention on any of his Radio / TV appearances that people are looking for old Terms and Conditions from the banks?
One way of reaching out to the masses and getting us what we need.
I personally am looking for Lloyds TSB Terms and Conditions for September 2001 onwards....

I emailed them via internet banking and they have said they will post it to me so lets see what happens .:eek:
Have you tried asking the bank for it. doesent look good for them in court if they say no

I know I keep harping on about T&Cs but it is becoming more and more important that T&Cs are available if you are going to court. Please can somone let me know where I stand with this situation
I requested my terms and conditions from MBNA(A&L) and made it quite clear that I wanted the ones from when my account was set up. I was told that those were not available as my original account was with A&L and MBNA did not have access to them. I told them I would accept the MBNA ones from when they took over the acount (2003 ish) and was told that would be no problem.
Well they arrived yesterday, and surprise surprise they are the recently updated version stating the cahrge as £12. I spoke to the Customer Advocate Office today and explained that these were of no use to me and I needed the old ones. I was told they did not keep copies of them. I questioned this and I explained that I thought by law (for audit purposes) they would need to keep archieved copies of previous T&Cs and was told they could not help me.
Can anyone shed any light on this please.

:money: hi where can i find terms and conditions for skycard/barclays,have requested them from bank but i havnt recieved them,had a letter from the court on thursday my case is on 12th july so i have to send bundles of by next tuesday, if i dont recieve them and cant find them on this site can i explain to the court? what will happen if i havnt got them?
