Where can I get old Terms and Conditions details?

  • Hi, have been on the CAG site to download Barclays T&Cs for 2001 (in case my daughter has to go to Court) but it is in booklet form.
    I have printed it out, but no matter what I do, it is too small to read.

    Please, is there a link to get this in printable/readable form.

    I have had my bank acc with HSBC for nearly 15 years. It has gone through a few guises as a student acc and then a graduate acc, both sorts of acc were exempt from charges at the time.

    The issue I have is when it automatically transferred from being a grad acc to standard current acc, I was never sent a letter with new terms and conditions, it just changed over automatically, in fact i only found out when I called up to query a charge.

    This was about 3 years ago and it is charges accrued during this time that I am claiming back. Furthermore, when I first queried any charges, I was advised by a call centre advisor abroad, that they are automatically applied by a computer, and could not be reversed (ie if automatically applied, why is there an admin charge?). Not only that, but I have never ever received a notification letter of fees being charged (although I was advised in prev call that I should). I do all banking online and have done so for a number of years, and the only notification I get is when a small icon appears on the internet site. I have to click on it and I am told that a 'notified fee of..' is being debitted, now whilst I know that this is probably for going over my limit, it has never actually states what the 'notified charge' is for, therefore is it actually a notified charge (hope that makes sense).

    Now am i being stupid, or am i right in thinking that for me to adhere to terms and conditions, they should have been sent to me when the account automatically changed, and also are the banks not supposed to send a letter when you are charged (thus justifying the term 'admin charge')?

    I am concerned as, if it goes to court, i don't have, and never have had a copy of terms and conditions for this acc, and they have never sent me a notification of fees letter.

    Any help on how to play this one?

    am in same position Al..I asked recently for lloyds to supply me with T&C,s for TSB bank 1995 neither the sols or the bank have obliged...with all due respect...write to both the banks and sols asking for specific terms of conditions applying to the years you need them.. take copies and supply the court accordingly if not....at least you have tried and it will go in your favour.
  • I would first of all ask the banks solicitors for the terms and conditions if they refuse or do not reply then repeat the request but add if they fail to supply you will ask the court for an order requiring there disclosure. If they still do not supply them apply tothe court for an order for specific disclosure in relation to the documents and for your costs of making the application. You cannot do this if the case is stayed so any stay would have to be lifted.
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person
  • Do I need a copy of my terms and conditions to go to court, if I don't will the court throw it out as paperwork not in order

    Hi,

    I'm going to court against HBoS in two weeks and am trying to get hold of a copy of the terms & conditions from when the account was opened in 2003, just in case the judge asks to see them.

    Does anyone have these or know where i can get them? It was originally a Halifax account.

  • I too have recently recieved a reply from Lloyds TSB telling me that they refute the charges I am claiming and just refer me to the T&C`s where do I go from here. Vectraman
  • it is suggested that in light of the 2 wins for LTSB, to win when going to court, you need to have a copy of the T&Cs, I as so many others don't have a copy of them. But as alot of people have gone to court and won has anyone got a copy of LTSB T&Cs for both credit cards and bank accounts
