The fact remains that someone has used force to restrain a person until the police arrive..
Is that legal? Yes..The law allows every citizen the right to detain a person using reasonable force until a police officer is on scene..What has to be decided was the force reasonable given the situation?

And why is 'phone call' in your OP a weird link?likelyfran wrote: »Nice! Customer care is alive and well!
The OP should have had an immediate apology on the spot - at the very least! I should think more than a 'small voucher' would now be in order - a decent sized one perhaps? £50?
She is a duty manager- the store manager on a day off. The lack of immediate apology was put down to her being "left speechless". Clearly only speechless in English I might add.Debt now £48,000 in the form of a mortgage0 -

Does this law allow a person to be physically forced into a back room of a shop and then searched by a security guard and manager?
Saying this was a citizens arrest is ridiculous!
For one thing it was the OP who called the police!
The company in question has made no attempt to justify the actions of the staff involved after reviewing the CCTV. I have defended the actions of the young male employee, as I feel he has no real responsibility for decision making here.Debt now £48,000 in the form of a mortgage0 -

Have spoken to a senior customer service manager of the company in question at length on Wednesday. They are aware that I have sought advice both here and with a lawyer. All I can say is that I am really happy with the way the company has dealt with this issue and that the matter is now resolved to my satisfaction.

There is no right for any citizen to detain another unless an offence has been committed. Suspicion is not enough.
That does not really make a lot of sense since only a court of law can decide if an offence has been committed and it would be a little late by then.
I suspect that it is sufficient for the citizen to have very significant proof (which they clearly did not have in this case).
We have heard from security guards here about the various conditions that have to be satisfied before they can accost someone. There are two types of people in the world: Those that can extrapolate information.0 -

Don't worry, the shop will cover the cost of this and other 'compensation' claims by putting up their prices...........
