The letters saying that they are investigating and have 40 days to respond are little more than acknowledgements of receipt and attempts to make you give up and go away. The 40 days timescale only applies if you are going to escalate the claim to the Financial Ombudsman.
If you have not received a full reply by 14 days from the date of your first letter, send them the second “Letter Before Action” letter, giving them another 14 days to respond or else you will start court proceedings. If you have not received a full reply by 14 days from the date of your second letter, start court proceedings on the MCOL website.

Bank Halifax
Amount reclaimed £783.35
Amount paid £934.55
The process began on 23rd March with first letter until today with a letter saying money would be paid into my account in the next 5 days :T
I did the two letters and included interest. Got to court stage, they acknowledged claim and in between sent me a letter to say charges were fair but made no mention of case at court, so i got a bit worried. But letter turned up today, paying charges, plus interest and court costs "without any admission of liability"
 :money: Cheers Martin:j

I'm also after charges back from Halifax mine are over £5300 ~(before Interest) though I've only asked for the £5000 (only I say!!!), when was your first letter requesting repayment? was that the 23rd? or was that when you first sent for the Statements?0 -
started court action against MBNA , issued on 22/5/07, they havnt, acknowledged or defended yet, if they didnt reply, when and what would be my next move, ??????0

Alternativly the simple calculation is 0.021% per day
ie total claim before interest x number of days from claim x 0.00021
Hi Loz
thanks for getting back to me. Just tried to clickon your name and it said you had chosen not to accept private email and therefore couldnt get through. Do I use the calculation you have provided on your message? I calculated interest on claim up to 31 Jan but nothing since then. Also I have further 300 charges since 31 Jan - not sure how to calculate the interest on these. Do you know anything about a "wasted costs order" I have heard them mentioned but have not done anything about costs on my claim. I have to have these in 14 days before hearing which is 4 July so I want to get the bundles out Thursday this week at latest. REALLY appreciate any help JayneGNat West - MCOL March - FatWest defended - hearing date 4 July - 2300 claimed and still having charges put onto account!!
HSBC - sent 14 day - still waiting for reply. MCOL by end of week - claiming 795 - eventually paid out £560.
Halifax - sent for statements Feb - cheque cashed - nothing received - reported to FSA - paid up almost amount claimed before official complaint registered with FSA0 -
hi everyone
I hope I am posting this in the right place
just found out about reclaiming bank charges
we have had loads of charges over last 4/5 years - we were having financial difficulty due to husband being ill and not being able to work - we weren't entitled to any help as we had a mortgage - hence debt got bigger and bigger - all becasue we needed money to live off of - none of our debt was down to being silly and spending on random stuff
We entered into an IVA in january, would we still be allowed to try and claim back any charges?
I reckon we should be due over £1000 in charges - maybe more
I have the template to ask for a detailed statement of all charges - so will be doing that tomorrow.
thanks for any advice
xx:jDebt free from 2010:j(except for mortgage lol)0 -

Hi,
I've downloaded a copy of the template for re-claiming unfair bank charges. Does anyone know what you should enter in the 'account details' space if you don't actually remember your account number. It was over 4 years since I had this credit card (american Express) and I have no record of the number. Would name and previous adress suffice?
Thanks0
