Thanks, yeah... I think i'll wait till Friday anyway and if there's nothing in the post from them by then, i'll get on the phone...
Oh, and am I right in thinking that I can only claim up to £750.00 using the Scottish Small Claims Court...? Because if that's the case, I don't really want to only get half of my money back...

Have a peruse through the 'Success' Threads (there are three of them now due to the amount of posts). I recall seeing several successes against stuff such as loans and mortgages.Reclaims in progress:

Hi everybody
My claim against Abbey is at a standstill waiting for a court date at the moment, so I thought I would start and look at other places where we the consumers seem to get ripped off on a regular basis.
I pay my Sky bill by phoning up and using my debit card (I used to pay by dd until thy screwed me up by taking to much) now they say I have to pay £5 a month more for not paying by direct debit so I am not paying it and taking Sky on over it, I have asked for a breakdown of their charge and the ball is in their court.
I know this is not the right place for this but I can't find a forum for this sort of thing. Does anyone know if their is one on here and how I can find it, I have spent about 3 hours looking and found nothing.
Can anyone point me in the right direction please??

woohoo!!! finally getting somewhere with cahoot/abbey! they have put £240 in my account as goodwill gesture (I am after just over £1000) and will accept as part payment but want the rest but quick question - can I spend any of this money or do I have to wait til they pay the rest????

what is the best way to put in a complaint to the ICO? via the online form or to send a letter?0

A few of us discussed the charges imposed by NTL (now Virgin Media) for the same thing. General consensus was that the charge would likely be classed as a service and you wouldnt be able to reclaim it. Good luck with it though I would be interested to see what happens so please post the outcome for us.0 -

Provided you write and inform them that the payment is accepted implicitly as part payment without prejudice and that you will be continuing to reclaim the remainder I see no reason why you cant spend it now. Be careful that the bank dont get the impression that you have settled in full and final settlement, be absolutely clear and in writing, not telephone.0 -

Either will suffice to make the complaint but one is not going to elicit a quicker resolution than the other, which is what I think you are asking really. The ICO are dealing with thousands of complaints and yours will join the queue and backlog. It will help if your complaint has evidence of complaint such as proof of posting your letters etc and it may be dealt with slightly quicker because of it.0 -

thanks for that - have sent a letter (and emailed it) stating that I accept only as part payment and will continue to claim the rest.0
