hi everyone
sent my AQ form off few weeks ago and today got a copy of the banks AQ form (natwest) still saying basically that there is no evidence that they have charge me manyer times blah blah, and now still waiting for a court date hopefully very soon xxxx0 -
Put in your name, any relevant addresses at the time and your date of birth and they should be able to trace your account.0

A few of us discussed the charges imposed by NTL (now Virgin Media) for the same thing. General consensus was that the charge would likely be classed as a service and you wouldnt be able to reclaim it. Good luck with it though I would be interested to see what happens so please post the outcome for us.

I am surprised that more people are not up in arms over this. I have a series of emails to and from Sky over it, in each one they specifically say;
"To ensure that we are able to offer you the ability to pay by invoice for our services, we feel it's necessary and fair for Sky to charge for this service."
As they say this and also;
The contractual method of payment is monthly by direct debit from bank account or credit card and as with many other companies a charge may apply in the absence of this."
"A charge of 4.00 (GBP) takes into consideration the cost of producing the paper invoice, envelope, postage payment processing of cheque/one off credit card payment/ giro, support and administration staff etc
I take that as saying if I don't pay by their methods they will penalise me with this charge. What do you think?
I have not paid their charge for 3 months now and have specifically asked for a breakdown of how they arrive at a cost of £4 to process a payment made over the phone which I pay for as well. I have told them I will not pay until they prove the cost and am also prepared to go to court over the matter.
Additionaly, I have now started paying by cheque because, I authorised a payment of £47.30 from my card and they took £51.30. I naturally complained over the matter and they blatently closed ranks and did nothing. I contacted Visa direct over it and was told it was hard luck I couldn't reverse the charge, it was basicaly the risk you took paying by card over the phone, Nice!
It would be good to know your views or anybody elses over this and once again, I know this is not the forum for this matter but I can't find anywhere on the site to discuss it and get other peoples points of view and I suppose in one way it is a similar sort of thing as taking on the banks.
Please let me know what you think Twinkly, or anybody else.

What losses are they then? :rotfl: A few stamps? If its the same team that handles Barclays Bank claims you'll get full payout just before it reaches court!But you might have to wait,
saw a post on here saying they had been waiting 8 months! :silenced: Sounds more like Bully Boy tactics to make you accept a lower claim! Besides if its in the small claims court I didn't think they can do that (considering you are claiming well under the £5,000 mark!).

hi everyone
put in for bank charges two month ago and found out i'd been charged £600. sent off first letter they replied that it would be another month before they could respond. Abbey have now sent another letter saying it will be another month, i feel like they are fobbing me off. Anyone got any advice what i should do next.

Abbey will just fob you off in the hope you will get disheartened and stop trying to reclaim.
So, I suggest you tell them, that unfortunately they have had your money for too long - not those exact words please! and that they have 14 days to refund you or you will start a claim through the courts.
They will probably ignore this letter, or send a standard 'we are sorry you are not happy with our service, we will investigate your claim and get back to you in a zillion years...'
Dont be down about the whole proccess, the banks are wrong on this, they know they are which is why they dont go to court and settle at the last minute.
I reclaimed £850 from Abbey last May, and I went through the whole proccess of asking for it back, taking them to court, them defending, them settling when they realised I wasnt going away.
It can be daunting, but stick with it, dont show them any mercy, did they when they took the money for the charges???

thanks for getting back to me. Just tried to clickon your name and it said you had chosen not to accept private email and therefore couldnt get through. Do I use the calculation you have provided on your message? I calculated interest on claim up to 31 Jan but nothing since then. Also I have further 300 charges since 31 Jan - not sure how to calculate the interest on these. Do you know anything about a "wasted costs order" I have heard them mentioned but have not done anything about costs on my claim. I have to have these in 14 days before hearing which is 4 July so I want to get the bundles out Thursday this week at latest. REALLY appreciate any help JayneG
Solicitors advice....Wasted Costs Order....you are unlikely to be awarded costs for attendance paperwork phonecalls etc and quite frankly your not even legally entitled to the 8% stat int...this is awarded normally at judges discretion and is merely a bargaining tool with the banks..

Hi All, seeking some advise. Claiming £2500 from the Nationwide. They have paid £736 back in to my account but no correspondence backing up why. Do I need to write to them or just carry on and go to court? Also can we spend the money?
