HI after sending all template letters to Barclays , their time for reply was up on Friday 1st June.and court action was the next step. However letter arrived Saturday morning offering £1770 of the £2400 (not including £420 interest) that i was claiming for, i want to reject this offer,so how do i go about telling them , is there a template letter for this . and do i also tell them that i am starting court action to reclaim my charges . thank you
Given that the amount they have offered in settlement is the full amount of charges less interest then you must accept this. Interest is only awarded by the judge on judgement in your favour at court and you arent entitled to it automatically sorry

Hi iam actually claiming from Barclays £2360 ,there offer of £1770 is not the full amount of charges, as i said this figure is without interest, (with interest the total amount is £2798)... so even though they are offering me £590 short of my claim,why must i accept this.0 -

I see, thanks for clarifying Geoff I read your post differently. In that case then no you dont have to accept it. You could write and accept it as part payment without prejudice and advise you will continue to reclaim the remainder at court. It may or may not prompt a better offer.
Of course to get the interest on the full amount you will need to reject the offer entirely and claim the full amount of charges at court. You can write and advise you reject their offer as unsatisfactory and that failing full repayment within 7 days that you will initiate court proceedings. This also may or may not prompt a better offer.
You can simply reject it and go straight to court but it wouldnt hurt to try and negotiate a bit.0 -
With reference to people saying they had been fobbed off by the bank, I myself sent 3 letters to the bank requesting that they repay all my bank charges. The last I sent by Special Delivery, which they said they hadn't recieved- so I got Royal Mail involved and they chased it up for me. The bank then turned on their previous statement that they hadn't recieved it and admitted that they had!!!! Anyway to cut a long story short- I've now had my charges back- all £1349 of them (only after waiting about 13 weeks!). My advice is to keep going, they want to make it as difficult as possible for you due to the "trend" of reclaiming (they are indeed suffering with resources to deal with the thousands of claims they recieve). Soldier on because it is worth it in the end! Good luck everyone.0

That's fantastic news Rodneypig- Well done!! I've just had my claim with Abbey transfered to the local court and am waiting to get an allocation questionnaire and date all i've had so far is a letter requesting another £100 costs. I'm hoping this will all get sorted soon - which email address did you use to start the negotiations for a settlement???0

barclays have paid out on our joint not what we asked for and then offered me small amount on my account dont know weather to accept or take them on how long will it take0

hi yea im trying to get my bank charges back from lloyds/tsb i have been waiting for 4 months the total amount im trying to get back is £1888.64p but just had a letter to say that they are not going to carry on with my claim:mad: !!!!so what do i do?can they do this or do i have to go further to get my money please can someone help me who has been trough this thanks samantha xx0
