I repeat - the guy has claimed charges from the initial date of his first letter to the bank. Read his original post again. The defence he is quoting says the bank can't confirm charges before Feb 2001. Doesnt say anything about a 6 year rule or that the charges fall outside a certain range of dates. That idea was put forward by another forum poster.0 -
my partner has a mortgage with birmingham midshires when he changed the payment date they charged him 160.00 for the privilege and also 35.00 every time he paid late would he be able to claim these back the same way as you can with the bank charges we've searched every forum and just dont know where to start or if its worth it any advise would be great thanks0

I am writing you today in further effort to ask you to consider my claim. I am most disappointed that you have not even acknowledged my previous correspondence.
I have been notified that the allocation Questionnaire is being dispensed with in this case and that it has been transferred to the Mercantile Court Leeds District Registry. I have written to you in the past, asking for you to consider my claim and reply to me. I have heard nothing. Were this to come before a judge, it is obvious who is making any and all attempts at resolution.
It is my feeling that you seem to have no intention of defending this claim in court and are simply procrastinating.
I am mindful of the vast number of claims with which you are currently dealing. In order to more speedily resolve this matter, I am willing to accept the sum of £4000 as full and final settlement of this particular claim.
I do not agree to waive my rights in respect of any other actions, nor do I agree to a clause of confidentiality .Please note if this were to go to court; I will be asking the judge to ask for a full breakdown from HSBC on how much it cost for the administration of these automated letters/charges.
Please find enclosed another copy of my schedule of charges relating to this claim.
I hope to hear from you very soon so that a reasonable conclusion to this claim might be achieved. I am sure that the courts would whole heartedly approve of our settling this matter in a timely manner and without their further intervention. I look forward to hearing from you soon

hi everyone,
i have recently sent my first letter to Abbey giving them 14 days which expires tomorow. i will then send my second letter giving them a final 14 days. i was just wondering if after the next 14 days would it be more effective to refer my case to the financial ombudsman or to the court? also, when, if any, would it be an appropriate time to call the bank and give them the chance to settle?
any help would be great.

Hi i was interested to read about your pay out, i am also with lloyds bank they have offered me 750.00 instead of the £1200.00 that i asked for what would you suggest i do next as i dont want to accept the offer, should i send another letter or go staright for the county court.

Hi could anyone please advise me, i recieved yesterday a settlemet figure from Lloyds bank for £750.00 The original figure was for £1200.00 i dont really want accept this offer but i am not sure what to do next, to write back useing Martins template for refusal or non response or go straight to court.or if anybody has anyother suggestion i would be really grateful i feel like i am so near.

Hi Alfie, I was offered £750 as a gesture of goodwill after they "looked at my account individully from other peoples"...I refused it and am now waiting for them to submit a defense as they have acknowleged my MCOL claim now (they did it on the last day)...I am seeking £2771, or £3236 in intrest....I made them an offer of £2700 without predjudice and had no reply so off we go to court it seems....Lloyds seem to be the longest to pay out I think looking at all the posts on here...0

hi recently wrote to natwest requesting £2795 back in charges, and gave them the 14 days as suggested in template letters, yesterda i received a etter from then saying they need 6-7weeks to process my claim! shall i press ahead and start to threaten court action or bide my time and wait for them?

It is up to yourself whether to go through the court or the FOS, but you will need to give the bank 8 weeks before you pass it over to the FOS. Their service is free!!0
