from her email it says she is the head of data protection and she sent an internal email to the legal dept.

Bank: Abbey
Claim: £357.49 (inc interest and court fees)
Amount Repaid: £357.49
Had to go nearly all the way! sent of letters requesting statements in March. Filed MCOL and the defended. Got a court date through for the 18th of June. Recieved an offer for £220 last week which I refused. Sent court bundle etc last week and today got an offer for the full amount.
It was a long hard fight but I got there ion the end.

HI after sending all template letters to Barclays , their time for reply was up on Friday 1st June.and court action was the next step. However letter arrived Saturday morning offering £1770 of the £2400 (not including £420 interest) that i was claiming for, i want to reject this offer,so how do i go about telling them , is there a template letter for this . and do i also tell them that i am starting court action to reclaim my charges . thank you

I found a phone number for Barclays Litigation Department (somewhere in the forums) and rang it today to find out who was dealing with my claim. I was given a name and their direct dial number.
I was informed that I needed to wait till I have a court date issued, then about 3 weeks before it gets to court I will be made an offer. They are unwilling to settle early due to the volume of claims but they will settle.
The original post said that they had been paid out in full! So anyone entering into the court process, just hang on and sit it out, you will get paid! 1.There should be a contact number at the top of the rejection letter, you should ring it and tell them you are not happy with the result, they may say that they will re-evaluate your claim.
2.If you had followed the templates on this site then you should have involved the courts through MCOL by now (don`t think you have though)
You should definately do this if you get no joy from the phone call.
3.If you are struggling for the court fee then you could pass your case on to the financial ombudsmanKeep right on!!0 -
Hi there i wrote to barclaycard requesting statements in march. I received 2 years worth of statements before their 40 days were up, and said they would send me the rest later. I sent an email to the ICO reporting this over 2 weeks ago but have not heard anything from them.
Does anyone know how long i will have to wait to hear from the ICO? And should i have wrote to them instead of the online complaints form?
Its been 2 months and i dont seem to be getting anywhere..

I repeat - the guy has claimed charges from the initial date of his first letter to the bank. Read his original post again. The defence he is quoting says the bank can't confirm charges before Feb 2001. Doesnt say anything about a 6 year rule or that the charges fall outside a certain range of dates. That idea was put forward by another forum poster.
In relation to the limitation act there is a post on CAG where it states (LLoydsTSB) customers only....There is an apparrent period of Concealment which actually opens up the limitation period, cant quite remember exact wording. Might be worth taking a look, however he needs to re-do his homework call the court in question and ask advice and before it gets to court he can amend the claim.0 -

I now think I have my court bundles ready for hearing 4 July. My court order said "each party shall deliver to every other party and to the court office copies of all docs on which he intends to rely at the hearing no later than 14 days before the hearing"
I am sending out the bundles tomorrow but can someone just confirm whether I need to include a "Statement of Evidence" with the bundle???Nat West - MCOL March - FatWest defended - hearing date 4 July - 2300 claimed and still having charges put onto account!!
HSBC - sent 14 day - still waiting for reply. MCOL by end of week - claiming 795 - eventually paid out £560.
Halifax - sent for statements Feb - cheque cashed - nothing received - reported to FSA - paid up almost amount claimed before official complaint registered with FSA0 -
