  • I am taking natwest to court, I have filed a court claim, it says started on 30/5/07, does that mean the 14 days start from then? MCOL seems to give you little info. do the 14 days mean that it is up as of 19/6/07?

    It's 14 days from the date the summons was deemed by the court to have been served. It should give the specific date on the letter you would have received back from the court acknowledging your claim. Hope this helps.

    I have had a partial repayment of about half the claimed charges, and I have just re-read the defence filed by Nationwide at the County Court:

    <i>Defence:

    "The defendant has refunded all charges debited to the Claimant's account since 2001 that had not previously been refunded. Insofar as the claim relates to charges debited to the claimant's account before 2001 it is barred by virtue of the provisions of the Limitation Act 1980"</i>

    They may have refunded one or two charges years ago when I phoned up to complain. I honestly can't remember, and anyway Nationwide did not supply their list of charges when requested.

    The Limitation Act does not apply in this case as I only opened the account in 2004. And it goes on-

    <i>"Charges totalling £xxx were refunded to the Claimant's account in May 2007. The further sum of £50 in respect of the court fee was also credited to the Claimant's account."</i>

    They forgot to pay the £50, and it is interesting that the only defence they lodged was that they had already paid out. So logically, if it comes before a District Judge, the only argument will be about how much more I get back.

    I have to notify the court that I still wish to proceed, by returning a form, copied to the Defendant's solicitor. Faxing it off today.

    Will let you know the outcome.

    Hi every 1

    I received my statements today from lloyds tsb, there fairly straight forward and easy for me to total up all my charges, ive read up about what step i take next, but i read it says i have 2 detail all my charges im claiming for in my next letter to lloyds... Do i really have to list every single charge as theres loads and could take some time.

    I hoping to get my next letter sent off in the morning, so any advice would be appreciated.

    Hi there,
    I wrote to lloyds tsb on 11 april 2007 and requested bank statements enc. £10 cheq they cashed immediately got statements 3 wks ago and sent ltr recorded delivery so i could check received requesting refund of £285. I closed my account in 2005 when i sold my property to clear all my debts and paid them in full. I have phoned today 3 times to 3 diff advisors to be told they will not speak to me due to d.p.a as they have to confirm who i am. I dont understand is this just a fob off from them confirmed all my details including previous addresses etc. They have had over 14 days since i posted my last letter req. charging to be refunded shall i just proceed with online claim now

    Our claim has now been passed to the Mercantile Courts and is being heared along with 300 others. We have been sent a CMIS to fill in. Please help someone as I don't know how to fill it in. :confused:

    You will need to list the charges yes, the bank wont know what you;re reclaiming otherwise. I know that sounds obvious but they do need to check off and compare to the account before they can say yes/no/argue about it. I found it easiest to list them all in the interest calculator in the main article and copy them to a word doc for printing off. You;ve got the file saved then for any time you need to refer to it. :)

    You are pretty much being fobbed off yes. You can proceed to the next stage now they've had adequate time to resolve the issue. Good luck :)

    HI after sending all template letters to Barclays , their time for reply was up on Friday 1st June.and court action was the next step. However letter arrived Saturday morning offering £1770 of the £2400 (not including £420 interest) that i was claiming for, i want to reject this offer,so how do i go about telling them , is there a template letter for this . and do i also tell them that i am starting court action to reclaim my charges . thank you
