    I'd like help please on the best way to proceed now that a few claims have been both paid out and refuted....
    I put a 40 day request to Barclays for itemised bank charges, handed them into my local branch and after the 40 days no reply, so went in. They told me it was being dealt with so i went home and to save waiting i have put together most of the charges from the statements i had at home, and put it in with the template letter. I have not added interest and i am trying for £3100. I definately got the impression they will be stalling the process. I asked for a reply within 7 days. They have replied with a complaints reference number saying they will contact me in a few days, and included a complaints procedure leaflet. If i have not heard in a week should i contact them and offer a settlement of say £2500, and if i do can they pay out quickly. The problem is i am totally skint and soon to lose my job. I really need this to come off quickly. Any tips??

    I have sent the letters to A&L requesting figure of £1960.00 and finally after about two months recieved an offer of £736.00, I am now in two minds whether to accept their offer or carry on ?? Should I ring and say I will not accept less than £1200.00 which is the figure less 20% or should I go for broke and demand the full settlement ???

    Has anybody been in the same position and could ofer some advice, after hearing all on the news about judges throwing cases out I am tempted to take the money and run !!!

    currently going through my claim with barclays bank, recieved my statements as requested within the 40day time scale, then did my first letter requesting my claim, on the 27th may had a letter back from barclays, saying sorry to hear of complaint and my comments are recieving attention and whilst they will endeavor to respond within my timescale, it could take up to 4 weeks, or even 8 wks? anyone else had this, what should i do next?

    I had the same thing with the A&L, Its just a question of being patient, I rang several times and got the same reply we have a backlog of cases to deal with !!

    Stick in there and keep pestering them on the phones as well as letters, eventually you will get to the next stage.

    I wonder if anyone can help/advise on the unusual development that has occurred today on my Small Claims Court proceedings.

    Background

    15th February - Wrote to First Direct asking for statements/charges for the last 6 years

    13th March 2007 - Received statements back from First Direct. Totalled up charges - £6767.12 + £1420.34 interest. Sent letter to First Direct asking them to refund these xharges

    21st March 2007 - Received letter back from First Direct refusing to pay back charges claiming they do not agree that the charges are unfair blah, blah, blah

    23rd March 2007 - Wrote again to First Direct asking for a second time for them to repay the charges back to me. Gave a 'without' prejudice' statement that I would accept £7K if they paid up immediately and told them that if I did not hear back from them within 14 days that I would start court proceedings against them

    11th April 2007 - No reply whatsoever from First Direct. Issued claim against them through MCOL

    17th April 2007 - MCOL confirms that claim has been deemed served

    20th April 2007 - First Direct file acknowledgement and intention to defend all of claim

    11th May 2007 - Informed by MCOL that claim has been transferred to my local county court (Swansea)

    01st June 2007 - Informed by court that 'as the result of an order made on 24th May 2007, this claim has been transferred to Cardiff County Court'.

    I have absolutely no idea what 'order' was made on 24th May. But I am a little mystified as to why the proceedings have now been transferred to Cardiff County Court.

    Has this happened to anyone else ?

    If so, does anyone know what the next step is ?

    I am still none-the-wiser as to when the actual court date is to be.

    I'm getting really pee'ed off with First Direct as they have settled many claims long before MCOL stage. Yet they are really trying to play hardball with me. We all know that they are not going to turn up in court to defend this claim but it seems they are being really bloody minded about all this. I'm getting concerned at how long this is all dragging on - especially as I am going out of the country on holiday on 6th July for two weeks and suspect it would be just my luck for the court date to be set for a day when I am sunning myself in the South Of France.

    Any advice/pointers that anyone might be able to provide would be gratefully received.

    Hello,
    I posted a success story for my other half a few days ago, but it seems all is not well.
    I have gone through the procedure myself and got money back from nationwide, my oh was following closely behind me, the mcol stated that they were going to defend (same as mine) when we received the papers from mcol it stated that nationwide has paid up on 23rd may. my oh checked his account and nothing....so he phoned nationwide solicitors and he said that it had been paid, He phoned nationwide and spoke to people there they stated that there was a problem the woman wouldnt say what and it looks like an error had been made and they need to send him a form out???????:confused: she couldnt (or wouldnt) help anymore. I never had to do this, does anyone have any idea what it could be for?

    Sorry to post this again but I really need to get the court/Cobbets bundle out tomorrow and could do with some advice. Someone did reply saying they thought I did need statement of evidence but when I read the thread on this it didnt mention it for standard directions - ie sending docs within 14 days of hearing. Any help greatly appreciated!!

    Nat West - MCOL March - FatWest defended - hearing date 4 July - 2300 claimed and still having charges put onto account!!

    HSBC - sent 14 day - still waiting for reply. MCOL by end of week - claiming 795 - eventually paid out £560.

    Halifax - sent for statements Feb - cheque cashed - nothing received - reported to FSA - paid up almost amount claimed before official complaint registered with FSA

    Presumably because Swansea court is busy, you need to phone the court and find out, they are the ones who will know.

    To expect a reply in 7 days is a bit optimistic. I'm assuming you have all of your statements and proof of the claim you have put in? You can certainly call them and ask if they will settle on an amount but you'll not find it a quick process I'm afraid and if they say no you then have to send the next letter giving them 14 days before taking court action.
