    Hi

Can anyone give me any advice?
I started my claim in March 2007. Last Friday I received a copy of the banks defence (from the bank themselves). MCOL states defence received effective 13/04/07 and I can go no further with my claim online. To date I have received nothing in writing from the court. Does anyone know how long this usually takes?

Also can anyone advise me as to what I should take along to the hearing once it is happening?

My bank is Abbey and the amount I am trying to reclaim is £2704. If anyone else is battling Abbey or sucessfully done so please get in touch so we can compare and maybe help each other along the way. It is quite un nerving to think that the average Joe Bloggs is taking a massive company to court!!!

    Thanks very much

We took on Abbey & won. They are stubborn to the bitter end but if you've done what you said, you're on the right track. It's sounds scary but the strangest thing is really this - the banks are MORE scared of going to court than you are! Keep going, follow the excellent advice on this site - you'll win!

    Bank Alliance & Leicester
    Amount claimed £639
    Amount got back £851

Followed tips on this site and got my statements.
Sent polite letter asking for £639 and got the standard reply stating their terms were comparable with other banks.

Did`nt bother with the second letter but went straight to moneyclaim on 18/05/07 and sent a follow up letter to court/bank specifying each and every charge i was claiming for, statuatory interest and court fee.
Had a letter from Wragg and co on 23/05/07 stating they were going to defend all of my claim.
Cheque arrived in post today for £851 (amount claimed + interest + £80 court fee. An accompying letter stated it was a ex gratia payment and they, the bank, would not close my account as long as i agreed to the terms and conditions of my account (£25 for unauthorised overdraft/ £34 for returned dd etc). I`ve cashed the cheque, and will just make sure i never go overdrawn again

You have given me the courage to take on Alliance and Leicester. Many thanks.

The letters saying that they are investigating and have 40 days to respond are little more than acknowledgements of receipt and attempts to make you give up and go away. The 40 days timescale only applies if you are going to escalate the claim to the Financial Ombudsman.

If you have not received a full reply by 14 days from the date of your first claim letter, send them the second "Letter Before Action" letter, giving them another 14 days to respond or else you will start court proceedings.

Please read the Reclaim Bank Charges Help thread.

All this may be too late as already in the court system awaiting a date
It is not too late, have you been asked to supply a further POC yet? If so you can telephone MCOL and ask about an application to amend, this costs approx £35.
If you havent had a further POC to complete then do your amendments on this, may be worth a quick phone call to MCOL though to see what they advise, they are very helpful and accomodating I hear.

    Good Luck
