Reclaim Unfair Bank Charges article discussion Part II

Palerie-head wrote: »Hello there everyone
I've been reading and taking your advice on here for some months now -so thanks for that, now I have a question over the stressful experience I am having in claiming £5000 of charges back from HSBC.
To cut a long story short, I just got a standard acknowledgement from HSBC after 4 weeks of them receiving my letter asking for a refund of unfair charges. So, I filed on MCOL and they acknowledged, then filed a defence, which seems to be the same one as a lot of people have had on here.
Now MCOL have referred my case to my local court, and in the form I received it says that the judge has decided to dispense with the allocation questionnaire. From reading the posts on here, people normally get them and I'm concerned as to why the MCOL judge has decided I don't need to complete one.
It has been 2 weeks now since MCOL sent the details to my local court and I called them this morning and they said that I will have a date soon.
Can anyone tell me why I haven't got to complete an AQ and most importantly, offer me some words of encouragement? I don't want the !!!!!!s to beat me but I'm getting a bit worn down by this process now!!
Thanks all x
Hi,
I think the AQ has been dispensed with all over the place (it happened to me) because it's a waste time (?) because the banks aren't turning up(?) but certainly you're not alone in this.
Be patient re the court date - there are so many cases right now that people are getting dates months from now. HOWEVER in most cases the banks are still settling (I believe). If in doubt browse the success threads (it's addictive so be warned!) and also check out the consumer action group for advice on your court bundle and how to get prepared. And don't worry - it's a waste of energy and it won't help your case! Best of luck XNatWest 1st account £985 refunded 2nd acount £5500 refunded (full amounts!)

we are not a lloyds tsb inside job let me make that very clear from the outset. Our case was heard at the county court in Lancaster for a total of 3k. To say we are devastated would be an understatement!!!!!!!!!!!!!!
Thank you for coming back and posting. Have a read of Martin's thread regarding these Lloyds cases as what he has to say may help you.
