    Hi

Sorry if this has already been asked but I've got two charges in February 2001, as these are just past the 6 years (thanks to Halifax taking 60 days to send my bank statements back!) can i go after these as they are in the sixth year or should I just go after the more recent charges. One of them is for £140.00 as one charge so I'm keen to get the money back.

    Thanks

    Lisa :o

You must make sure you exhaust it internally first with your bank, have you sent the LBA yet? If so stick to the timescale you gave them and go ahead with court, if not, you must be able to show the court that you have tried to reach an agreement before you claim.

Yes I have sent all the letters off to them just wondering if I should give them another week or two for an appeal or should I just start the court action and claim charges and interest. I would much rather have 8% extra but just thinking how long it could drag out.
My Mission today is to have an opinion on everything.
If you don't like it well you will just have to lump it!

After all the help on this site:

    Bank: LLYODS TSB
    Amount Reclaimed:£3895
Amount they paid: £3895 plus £120 court cost.
    The story:

Sent first letter - came back saying i signed T&cs so tough, Sent second letter saying unlawful and not agreeing with them whole amount in 14 days or ill take to court. After 14 days no response. Phone LLyods who on phone said that my letter was being investigated still so i advised that i would confirm in a final letter that date i wanted a reply to or court procedures starting. No reply from LLyods. Started money claim aftyer 14 days. After the legal 14 days after starting the procedure there was no response from llyods so i filed for a judgement. within 24 hours judgement passed. Give 14 days and on day 13 the money was in my account!! WOOHOOO

    THANK YOU MONEY EXPERT:money:
If no reply from Lloyds from first letter sent 23.4.07, what do i do next

I have sucessfully claimed money back of about £950 from Halifax, had to get to the court stage first though but paid in full so all good.
am going to try with HSBC now but this is a closed account so don't know if i will have any luck
I'm also claiming off Halifax, can I ask if you had to go to court or did they settle first? I've been told they are going to defend but I've heard nothing in over a week, I have no idea what to do next. Will the court contact me and tell me what I need to do before the court date? Also it is in Northampton Court and I live in south Wales.

A week is just a short time in legal procedural terms.

Northampton Court is a clearing court for MCOL, you will be transferred to a local court.
Hamsters have no tact and diplomacy, nor do they want any.
  • Hi all,
Just looking for some advice. Just starting the reclaim process having just received my statements from Abbey. My Q and worry is that 10-11 yrs ago had a bank loan from abbey for £5000 and then through serious illness and the inability to work after was unable to repay loan ending up with abbey writing-off money owed. I am now looking at reclaiming just over £3000 and are wondering if previous history will come back to haunt me if i have to go all the way to court.
Any help would be greatly appreciated as i am in two minds whether to carry on especially with the latest news of the bank winning in court.
    yours gratefully
