  • we have just got the acknowledgement from the court as the nationwide building society is defending the claim in full they have 28 days to file a defence so we will let you know what the out come will be.

    Depends on your overdraft how much interest you pay and no you can't claim it back nor can you claim back an arrangement fee. As for the monthly £10 - £14 fee you will need to ask the bank what it is for.

    As Kurt has also replied, I'll clarify the arrangement fee as its usually an annual fee on a business account and so a service fee.

    Thank you for that information. On our personal account which according to the statements has not been used by us since Dec 05, but did have a balance outstanding -there is a charge for a default notice fee. This was opn 10 Jan 2006, however they have continued to add intereston a monthly basis for another year - can they do this??

    It amounts to an extra £420.

    Sorry forgot to add this:

    On the business account the overdraft figure has increased by £1600 through interest charges even though this account should have been oficcially closed as the company went into receivership long before Dec 06. Help!

    It's still interest and not a punitive charge.
    Hamsters have no tact and diplomacy, nor do they want any.
  • The Halifax actually owe me, wait for it, £7888 :eek: excluding interest!!!! I couldn't believe it. I don't know how i'm not a homeless bankrupt. They've replied to my first letter and obviously they think they're right and i'm not getting a penny. Second letter is about to go, hopefully this will work. In view of the amount i can't use the small claims court. Has anyone threatened using the county court? This site is fab and has really made me adamant to go thro with it.

    And any monies reclaimed will go towards the debt held by the bank even if the account is closed.

    This is what I am trying to find out. I have no problem with the monies going to the bank as it will reduce the outstanding amount. Especially as they have a charge for this debt. I do have a problem with them charging interest for approx 18 months when the company was liquidated and they have continued to add the interest for an extra £1600.

    If there is an outstanding debt they are entitled to charge interest on it. If you can prove they were charging interest on monies that were unlawfully levied then you have a case. Proving it is another matter though.

    Thanks for your help. Answering in plain English is so much easier to understand. I have checked with MCOL (did'nt know you could) and discovered that Lloyds TSB have entered a defence. Does this mean that it will be transfered to my local court and that they will contact me and send an A Q if they are still using them?
    I am feeling really panicy now.
