    As soon as you get to that 28 days in total (from the date the summons was issued ,as stated on the 'Notice of Issue'), go back on to the MCOL website and see if the bank has entered a Defence.

    That should read the date the summons was served, ie up to 5 days after the date of issue.

    Trying to reclaim late payment charges,from car finance company, had a letter this morning saying blah blah about agreements, then last paragraph of their letter says......"The OFTs recent publication of its findings into default fee charges only applied to bank and credit cards and did not apply to auto finance.Our view remains that we are entitled to charge these fees.", are they right?????? or shall i ignore them and press on with court proceedings?

    It's up to you whether you want to or not, but if you do you have the law behind you.

    well ....got up this morning,went online,filled judgement!mcol says judgement filled!
    got home from work letter in the post for transfer of hearing!!!!!
    sooooooooooooooo...pixxed off!!!

    Hi again what is happening? strange since I went online late on 21st and there was the defence filed, but I have received nothing in the post. I am reading as much as I possibly can at the moment

    regarding lost tsb case surely when the banks do not turn up to defend and the judge asks us quetions it is like he is representing the banks. no turn up no defence.

    The judge has a right to get you to prove that you have a case under the law before he makes a default judgement. Mr Beswick didn't prove that.
