hi merck as you can understand there was a bit of suspision going on the reason being is there was lot of worry when lloyds won the first time!! and it scared alot of people off claiming against all banks, i dont know what your going threw and personally wouldnt like to experance it myself as does anyone so all we really wanted of you was a little information just so that the same things dont happen again!!!
I know this must be hard for you and to be honest it is all swings and roundabouts with this everybody is experiancing differant emotions i do hope you are going to appeal against this and you are very lucky not to have so much media coverage because to be honest i thought the day that the banks won again, it would be plastered everywhere to stop people claiming.
I do wish you luck with this and i hope you do come on this forum again to tell us your experance. I do apoligise if i have upset you in anything i have put, but it was my own opinion and it just seemed unrealistic.0 -
dose anyone agree,the reasons for people going overdraw. years ago when you got a bill,you would most probably pay it after a red letter or two at most probably the post office.these days with discounts for paying by d.d.s. or s. o. s. and in some cases the only way to pay some bills. your monthly bills are all together at the bank, adding up to a tidy sum, these have to be paid on the right date. get my drift. you could even stall on your mortgauge for a few weeks if needed.so in those days you never hardly had bank charges, just a lot of red letters flying about.it is so easy today, if you have a unexspected bill eg, need new engine for car tele blown up, kids need something, all quite nessasary. then you think okay i will incur penalties but at least the bills are paid, the trap has been set.these utilities etc, have more or less forced d.d.s. on the public.i am self employed if i do a job for joe bloggs down the street he should pay me on 1st of month say, my d.d.s. go out on 5th of month, joe bloggs does not pay me on time as agreed, result penalties i can not go to joe and charge him penalties if it was the old billing system i would be able to manage it better. so now i need a exspensive overdraft facillity to cover late payments. meanwhile nick keep taking our money and spending it in the student union bars, the real world wil arrive sooner than you think.0

This is my debut on this site. I have been using Martins step guide but now I am confused. I've got as far as receiving Notice of Acknowledgement filed in the Northampton County Court dated 8th May 2007. I have watched Martins video on reclaiming bank charges and read through the 'Victory' paragraphs and it says 14 days to acknowledgement of service then 14 days to file a defence. on my letter from Northampton it says 28 days to file a defence. Am I getting this all wrong. I have tried not to bother anyone so far, I have tried to read what other people are doing but now I am getting scared. I'm reading about bundles of reams of pages which is scary. I had hoped this would have been settled by now because of the comparitable low amount (£661 + £80). I am doing this for my son (who is serving in a war zone at present ) and was hoping that it would be settled before he came home. Sorry this is so long but can someone please help me through this.
I am realy feeling the strain on both counts at the moment.

I have just received my statements from RBS for an old business account. When I look through them there seems to be a monthly charge which varies slightly (£10.00 -£14.00). More importanlty is the interest I have been charged. On the statement is says INT TO 16MAR A/C ........... £117.58/JUN£359.65/15SEP £383.45/16DEC £262.10/16MAR £270.43/15JUN £285.78/ £15SEP £277.47/ 15 DEC £268.03/16MAR £275.06/ 15 JUN £282.24/£14SEP £292.87/ 14DEC £307.11.
Also an overdraft arrangement fee of £100.
Hey is this just me or are these figures ridiculous???????????????????????

The rules are that they have 14 days to acknowledge service or file a defence. If they acknowledge service but don't file a defence within the 14 days then the 14 days they have to file a defence increases to 28 days from the date of service.Hamsters have no tact and diplomacy, nor do they want any.0 -
omg are u guys stupid or something, how do u incur charges so much, dont u realise u have to pay money back or will be charged? iv got fined 25 and thought it was a big deal but reading this..
You are obviously too immature to understand what goes on in the real world. Do you know there are people on here who are senior citizens who have brought up families seen many children through university, worked hard for 53 years!!!!! very small pensions, own their homes and want to stay in them !!!! and are now living on a much reduced income who have arranged overdrafts with expensive interest (banks do not agree to without assets or collatoral.) What do you think of the government borrowing then? makes everyone elses debt fade into oblivion!!!!! Do you think 'the chancellor' (any party) is an idiot, everyone an idiot except you?
Also no one would have objected to a charge of the true amount of £2 per item as it is applied even when you go over by £1,!!! but as Martin says the £30 and £35 charges are an illegal disproportionate amount.0 -

You cannot claim back interest (unless it is for interest on unlawful penalty charges, and even then not without some very complicated calculations and a good chance of getting it wrong).
As far as the OD arrangement fee goes I'd recommend writing to the bank or going in and asking what it means. To me it sounds like that they are retrospectively changing the names of things to make them appear to be a service fees, something they were specifically told not to do by the OFT.Hamsters have no tact and diplomacy, nor do they want any.0 -

Depends on your overdraft how much interest you pay and no you can't claim it back nor can you claim back an arrangement fee. As for the monthly £10 - £14 fee you will need to ask the bank what it is for.
As Kurt has also replied, I'll clarify the arrangement fee as its usually an annual fee on a business account and so a service fee.0 -
The defendant (the bank) has 14 days to acknowledge to the court that you have issued them with a summons, which they appear to have done on May 8th. This was obviously done within the 14 days after they had been served with your summons. After that 14 days is up, they have a further 14 days to submit their defence to the court - in other words, 28 days altogether from when they were first served with your summons.
When you issued them with a summons, the court would have sent you a letter called 'Notice of Issue' and below the box with your name and address in it, it gives details as to when the claim was issued, the date they have to reply, etc. and when the summons will be deemed to have been served.
As soon as you get to that 28 days in total (from the date the summons was served,as stated on the 'Notice of Issue'), go back on to the MCOL website and see if the bank has entered a Defence. If they haven't, ask for Judgment by Default which is very straightforward to do, right there and then. There shouldn't be reams of paperwork for you to do at all! Ask for immediate payment when you apply for Judgment by Default too!
Don't be put off - go for it, even if the bank enters a defence.
